Gurus...

I am eligible to capture priority date from eb3 (PD:Jun 2002) to
eb2(PD:Jan 2006) .
So my priority date is current back in Nov 2007.
I submitted my wife 485 application and TSC returned with message "VISA number not available at present time".

Not sure what else i can do ???? ...so that TSC will notice the recapture of priority date.... which should make them accept the application.
Any body with some ideas???.

I will try resubmitting the same packet ...

USCIS is funny always, After they accepct applications they retorograte and then say again no Visa available.

Why should they accepct AOS applications in first place? god only knows there process.

It is just Horrible.

Type them a letter giving the dates you applied and add a print out of November visa bulletin and attach copies of you old and new LC and a copy of I140 to show the porting of PD. Send a letter to USCIS and a copy one to USCIS director. Attach the mailing stamp of your original mailing application to show that the PD is current.

Notarize all copies and send them they should accept. If your company has an attorney ask him to do it. If you are paying, I would say don't go for attorney, just do it yourself with notary. It should work.

Even for EB2 India current PD is 01 JAN 2002. May be thats the reason they sent back the application, as your ported PD is not current.

He is saying that he sent the application in November 2007. EB2 India for June 2002 was current for November 2007. So, if he can provide the tracking info such as USPS expressmail, UPS or fedex tracking OR a original stamped envelop with November Date he can still get USCIS to accept his case.

He better work on getting it accepted. Who know how many years it will take to get June 2002 EB2 for India current again.

485 - Returned again by TSC USCIS

But now CIS says that i cannot transfer priority date
because the EB3 (PD : Apr2002) filed by company A
and EB2 (PD : Jan 2006) filed by Company B.

Does anyone have experience or any memo to say that priority
date can be transferred even when the companies are different.

in fact thats a right way of porting PD with diff companies....it is less logical that the same person works for the same company in EB3 then later on files for EB2 ans we r told that experience in the same company doesn't count etc...
its just plain BS...i have seen posts in this forum where PD were ported successfully across employers and EB categories...pls look in iv.org also..

anyways seeing the bulletin trend maybe its better to be with EB3 for a while..
