Sponsoring Spouses

Your husband has OPT. This is not the same as having an EAD, so any answers about having "previously had an EAD" should be answered "NO". The answers are:

"Family based immigration"
"Permission to accept Employment"

Also I don't understand why your husband leaving his job makes "EAD" irrelevant. Right now if he wants to work after his OPT expires, he needs an EAD. An EAD is not tied to a particular job, it would allow him to work for anyone.
 
well he said that although he has an EAD pending, he will need to resend an EAD with the GC application. That is what I sorta meant by irrelevant.
 
How does he have an EAD pending? What was the EAD application filed on the basis of? I thought your husband was OPT moving to J-1 or something? Neither of these are EAD.
 
he has an H1 pending. His employer has submitted an H1 visa sponsor and he says he should get his H1 in October.
 
A H-1 is not an EAD. So the answer is "No".

Don't get the fact that the EAD is an "Employment Authorisation Document" and H-1 authorises you for employment mixed up. I had an H-1 before filing for AOS and correctly answered "no" to any questions about whether I applied for an EAD or had one before.

ahhh!!! I have some more questions :( I-485...what is the "Expires on" date? Will it be the F1 visa date, or OPT date? And how do I find out his A# and alien registration number (im getting confused about these two)? Also, is cevis code or annotation number or alien registration or A# the same? And, on his visa there are two different numbers: 1) Control Number and 2) Annotation Number. Which one will I use for Nonimmigrant Visa Number?(The Control number is listed on top near the issuing post name) on the F1 visa)?
 
I can answer the A-number question, which is he won't have one yet, so you should write "None" or "N/A" when they ask for the A/Alien Number.

put the date on the OPT card. for expiration date.
he doesn't have an A# yet. the one on the OPT card doesn't matter anymore. if you put that one down, nothing will happen, but they will give him a new A #.
the A # is also called the alien registration number. as i said above, he doesn't have one yet. cevis code and annotation number are not the same thing as the A# (or alien registration number)
the non-immigrant visa number is the number in RED on his visa. it should be somewhere around the right corner of the visa (i don't remember right now, but i know its in red). it's not the control number.
 
hey thanks for all your replies....I sadly have not finished applying for GC yet. I still have a few questions :s Now if I were going to use my husband's income for I-864 (Affidavit of Support) will I need to get a tax transcript/w2/pay stubs (whichever) for his or just mine? I already have only mine...but want to make sure I dont need his.
