Sponsoring B2, I dont have H1 stamping...

Hello All,
I am trying to sponsor Visitor Visa(B2) for my parents, I have been on H1 for the last 1 year. But there might be an issue, I dont have a H1 stamping in my passport. I have a F1 stamping, but i has expired. I have all the pay stubs.
I just never left the country and i didnt get my stamping yet.
Will this affect my parents application ?
Also, in the letter from by bank, is it necessary to show the average balance for the last 6 months. Can i just show the current balance. I understand that showing an average balance makes a stronger statement.

You not having a valid H-1B visa should not have any bearing on your parents' visa application. You are in status and that is what matters more than having a valid visa.
 
H1 Extension applied, no approval yet

Hi,

I am in a similar situation, with one more additional complexity. My visa and I94 expires this month end. I applied for H1 extension almost 2 months back, and I got the receipt notice. But the approval has not come yet. Is it OK to apply for my parents Visitor Visa? will it be a problem if they go for visitor visa now, before the H1 approval comes?

You not having a valid H-1B visa should not have any bearing on your parents' visa application. You are in status and that is what matters more than having a valid visa.

Since your EOS is in the works, you are considered in status. Your status is important but not as important as your parents convincing the local consul that they are not potential immigrants to the US.

Hi Karnish,

Please let me know what happened in your case. I have the receipt, and also my case is approved. But I have not received the approval notice by mail (but I do have an USCIS email copy of approval details).
Did your parents get the Visa?
