My wife who is an American Citizen has sponsored me for green card. On Dec 2003 we received a letter and the letter stated that I 485 will take from 365-540 days. On May 2004 we had our interview and the immigration officer said after clearing FBI back ground check you should get your GC.
On Oct 2004 we moved and I fill up AR-11. And On Nov 2004, I received letters from Baltimore as well as Vermont Service center to my new address about I-765(EAD).
When I enquired about my case in Nov 2005, after 20 days I received a letter from immigration that, my case has been closed since I failed to provide the necessary document, which they have requested from me on Jun 2005 letter, but Jun 2005 letter was sent to my old address which I never received.
After talking to Baltimore office finally Baltimore office did a Service motion to reopen and when I enquire about a month they told me they will review my case and they will let me know in 90 days. Moreover my EAD is expired and I cannot work. They refused to renew my EAD.
Question1: How long does it take for them to review a case?(is it 90 day or it could be more)
Question2: My wife is thinking of suing USCIS, if we do so, how long does it take for the case to be heard by court? Is it a good idea to do so?
