Speeding ticket..

Hi,

I got speeding ticket back in 2001 and went to court and paid $600.
shall I need to mention that is N400? It is called as Reckless driving at that time.It is beyond 5 years period. Apart from this, I have clean driving history so far..Any info will be appriciated. I Am ready to send out N400..thanx..
 
As it is >$500.00 (hence more serious than the garden variety speeding tickets) I would mention it even though it falls (just) out the 5 year period. You will need to bring the ticket and court document to show that it was paid off and there were no further charges.

I would also bring along my driving record to show that I have been clean ever since.
 
The question on the N-400 application form is "Have you ever committed a crime..." The ever is in bold font and it does not provide a 5 year window. Additionally, for fines over $500 one needs to provide documentation along with the application.

NO, you need to send the documents NOW with the application package. If not, be ready for a long name check process.

how many days I need to wait to get this document from DOT?

That means, I just need to bring ticket & court doc to interview..
I don't need to put that in N400..Is that right?
If I put this info in N400, need to attach proof right away to application,I beleive. Thanx...

A speeding ticket is generally not a crime; it is a citation for a civil offense. It only rises to the level of a "crime" if it is severe enough, like going 25 mph or more above the limit (of course, this varies by state).

However, with this particular ticket being $600 and labeled as "reckless driving", it probably was severe enough to be classified as a crime (most likely a misdemeanor) in that state. Before answering yes or no to ever having committed a crime, the OP needs to clarify this with somebody who knows about his/her state law.
 
Usually you can obtain certified case disposition from the clerk of the court where the case was heard. Certainly a pain in the backside... but necessary in the long run.

Yes you need to bring these to the interview. There is no harm to attaching a COPY of these documents to your N-400 but it will most probably be ignored - happened in my case. Your application receipt will have instructions to bring the related documents to the interview.
 
If ur case more than 5 yrs old U r fine dont worry about it.... go on ur N-400 bring any docs. during interview.. if the IO will ask u, explain what happen..but if IO dont ask anything u dont have to say bout the ticket.. that case is old...
 
If you can not find the document, then that is fine. You don't need to delay your N-400 filing. But you must provide a separte sheet with explanation along with your N-400 application. Not doing so will subject you to additional delays and security checks. This is based on my observation over the years. USCSI would like people to be upfront about information. Many on these boards suggest if the violation is more than 5 years not to "mention" it. The N-400 application instructions is explicty clear about any fine above $500 (which thus includes your ticket) to provide documentation WITH the application. There is no ambiguity here at all as far as i see it.

Finally this is what I am doing..
I am sending out N400 today without mentioning any thing about it..
while it is in the process towards receipt & FP, I gonna work on get documents and will be ready with them for interview time.
Any comments..? Thanx..

I put all exact dates based on employment offer letters. If you can find out the dates, its better.

I have checked with an immigration lawyer about driving records. He told me that you are only allowed to post driving offenses from the past 5 years only.
 
Please ask your lawyer, where in the form USCIS expressly states "Only 5 year" driving offenses to be posted.

The 5 year window is for the USCIS to determine the eligibility based on moral turpitude grounds, but they do want to know "all' violations of the law - both civil and criminal.
