Has anyone taken TAX deduction for the money paid for EAD and money paid to lawyer for that EAD.

I was reading IRS guidelines and it says you can deduct this money from your taxable income.

If you itemize deductions then it might be possible to deduct EAD fees as job related expenses. Check with a good tax practitioner.

I called up IRS support line and the rep. who I talked to said I could, since an EAD is necessary to keep the job and falls under the category "legal expenses towards keeping the job".

However ,
1. You need to itemize your deduction instead of going with the standard deduction
2. You can only deduct the portion of the legal expense that is more than 2% of your adjusted Gross Income( Refer to Schedule-A lines 20-26).

Search the forum ... there was a discussion on this topic couple of months ago. INS fee is definite but Lawyer fee is a gray area.....
