My boyfriend is asylum. He had court hearing in the beggining of November but he missed it due to moving from one place to another. Of course he notified the lawyer long before the court date so he could have enough time to transfer the papers and to set up new court hearing. But the lawyer have been so busy that he had forgotten about my boyfriend's case and now we have couple days to come up with good reason why he didn't show up. My boyfriend is not the primary applicant his mother is, but she has other plans now, I suspect she is gonna leave the country and may be cancel the asylum. Can he apply for himself now? Please, please any advice...
 
How old is he?

First of all, looks like you need a better lawyer - someone who can actually give you this advice you are looking for.

Secondly, he can apply on his own. If he is under 21, he won't get a green card through his mother in time anyway, so he'd better. But I don't know if he was persecuted "enough" back home. Maybe his mom should stick around until he is approved?
 
Thanks for replying back. He is over 21 now. His mother never got asylum approved. Her application was denied. So the chances are if he can do it alone for himself now. And yes we need better lawyer but ...we have already paid this one in advance, so now we are stuck

are you US citizen or you have some other status? What about marriage? hope this is not too much, but if the marriage is out of question, then find better lawyer ASAP. If you are in the midwest, I can give you a name. If not ask somebody else here on the forum.

I am asylee, and I am waiting for my green card. So there is no way to help him...at least for now. So if he try by himself is may be the only option since his mother is leaving the country.
 
there's always a solution

if the money for a new lawyer is a problem you should try a) get your money back telling your present lawyer (unless there is strict agreement stating he is entitled to keep the money no matter what) that you are going to report him to the American Bar Association (http://www.abanet.org/home.cfm) and, b) try to get some pro bono (no payment) help. USCIS is giving you a good link to a pro bono Programs (Free Legal Services) at http://www.usdoj.gov/eoir/probono/states.htm

and YES, if you marry him and you do have a valid asylee status you may apply for his asylum ONLY if you have been granted your asylum within the last two years.

I didn't get it.Is he asylee or not???You said his mother's application was denied.I presume either was his.Another suggestion he should be more serious
about what he is doing and never miss court hearing.And plus how can he apply for asylum if he has been presented within the U.S. for more than 1 year as far as I understand.And definetely change your lower.The one you have, is very unprofessional !

Thanks for the link I found a really good lawyer who's intereted in my boyfriend's case and will be able to help. He also will be able to separate my boyfriend's case from his mother so he could applay for asylum himself even though their in deportation process. So there is still hope.
