Some info might useful for the Retrogression.

I talked some INS officer and it might be a good idea to share some info on the "Retrogression".

What I heard is: "Retrogression" is more likey based on if I140 approved before 01/01/05 or not. That is, if you I140 approved, you might not need to worry about the "Retrogression". The original words is "you won't be tagged if I140 has already been approved". Which I think if your I140 approved, you already got a "Visa Number" and basically "Retrogression" is for the limited "Visa Number". Since you already have a "Visa Number", you won't use the quota again so your case will be continously processed.

On the other hand, it also means if your I140 not approved so far and you are in EB3 and from those countries, it might be true your I140/485 cases are tagged and you might need to wait for some time to reach a correct point.

I hope it will be helpful and I wish everybody can get approved soooooon.
 
This could be good news. I hope the 'INS officer' you spoke to, knew what he was talking about, and also what he said is true.
 
i have also posted that a request to get visa # from NVC is made within 3 weeks of 140 approval ..when visa # is issued is well debated.. some link with 140 approval ..some with 485 and some link this with gc issue ( even passport stamping )...
to me FBI name check is bigger problem then retrogression ..and it can really take meat out from our case

Talking to random USCIS officers is likely to lead to random answers. ;)

No. All an approved I-140 means is that you are eligible to receive a visa number. The actual allocation is done at the consular interview or right at I-485 approval.

No. You have not been assigned a visa number. You have just established your eligibility to get one. If one is not available, then you wait. According to your INS officer's logic, then I-130s and I-140s could never be approved if the PD was not current, since there'd be no available visa number to assign. I can assure you that (especially I-130s) get approved all the time way before the PD is current.
 
What I got from the Rep might be wrong. I just post what I heard from the Rep and you may use your own judgement on this one.

As for those approval with LC PD > 01/01/2002 and EB3 and from those 3 countries, I do see some approved cases in this forum. Please search carefully.

Personally I don't know if what the Rep said is true or not. Besides, it is not MY THEORY (I have no THEORY). As for you trust or not, again, please use your own judgement.

I hope what I posted can bring some hope but not debate.
 
These IIO's can never be trusted for their information. I agree with TheRealCanadian. I don't think we are seeing any approvals for the I/C/P EB3 category people (the couple of one's we saw might have ben actually adjudicated at the end of Dec'04). But i would guess that PD dates will start moving forward from March.

I wouldn't bet on that. We'v had rumors about dates moving backwards for some months, before they go forward again. In the immigration world usally I have seen all the 'bad' rumors turn out to be true, unfortunatly :( . Lets wait and hope thats not the case this time.

There is no true theory or no such standard processs....with UCSIS
All the approvals are just like Big Game lottery hitting millions...
 
Well Iam not so sure about this... There was this one "ed_mazumdar" guy who got approved on 01/05 with PD > 01/02.....OR may be I am wrong !!!!

Understandm, If that is the case, I will pack my stuff the second after i knew the news...
Unfortunately that was a bad example...

i think 'ed' might have been approved in dec ( also that was his second posting !! ).. MunnaMobile seems more accurate..

Can we add retrogress theory that those who got the RFE before 12/31/2004 and affected retrogress cases got approved. :)
 
From the over all observation, the recent approvals are only coming for EB2 or EB3 with prior PD. I think that now we are sure about the affect of PD on the pending I/C/P EB3 cases. These cases will be in hibernation till they process the applications having PD < 1/1/2002 .
 
Well...Maybe its better not to jump to such a conclusions....cos starting from Jan 01...We are hardly seeing any approvals (Eb2 or EB3)......

May be we should wait another 3-4 weeks before before making a reasonable conclusion....

SEE MY LUD's

Hi all
We responded to RFE on my Wife's case on DEC 14 th.... after that her 485 LUD changed on 12/16,12/17....

Then Both Mine and My Wife 485 LUD changed on 1/11,1/12 ( No Message Change)

I got 7 th year extension approved on 1/10.
So not sure 485 LUD triggered because of 7 th year extension.... or really some one looked in to my file to take some action.... GOD knows.....

I opend thread for this... people responded that saying they did not see 485 LUD change when they got 7 th year extension....

Hoping some good news will come soon.... but very little hope ( 2%)
because there is a chance that they opened my file, and realized that my PD is not current......and closed file....... :confused: :confused: :confused:

I opened the referral on 11/9/04 on our both cases, before we got RFE. We got response from USCIS, on Nov 29 th saying:

for My Case: Our Computer systems show that your petition/application is still pending service consideration. Please allow 30-60 days to hear from this office.

As I got letter dated on Nov 29 th, I am waiting to complete 60 days to call them back. I am going to call back on Jan 30 th so.... I will update the forum

for My wife:
A notice was mailed to 11/16/2004 to xxxxxxxx. Please contact them to receive a copy of notice. etc etc....
