The truth about Social security is very unfair and painful for people like us who might be forced to go back to our own native country. The law says that we must pay the social security tax even though we do not expect any benefits in the future. What’s more, we cannot get any refund once we leave this country. Many people on H1B visa feel that it is extremely unfair to the employment base immigrants. Some people feel that it is like a daylight robbery, but so far we can do little about it. ISN used to have a lobby group work on this issue, but there are so many other more important issues than this one.
However, the social security tax law does have some exceptions for people who are from Canada, European countries, and Japan. Those people might be eligible to get their retirement benefits from social security administration once they reach the retirement age, even though they no longer reside in USA. That is because those countries have tax treaty with US. For the majority of the H1B immigrants who are from India and China, there is not even a slight chance they can get their SS tax back, according to the current law. Unless the current SS tax law changes, the contribution you made is just like any other taxes you paid.
