So Close to Oath but it may not happen

I have been contacting many of you in the last several months regarding my US Citizenship. Following is a summary of what happend and I appreciate if some one can shed light on my unique case.

I was divorced in year 2000 in US and my wife fled the country with my son and filed a dowry case in India so that I will not be able to see my child.

I have filed for my US Citizenship and following are some important dates.

PD: May 31, 2005
FP1#: July 30, 2005
Interview: Sept 12, 2005
Background check: Cleared on Sep 27, 2007
FP#2: October 25, 2007

Since then my name check and background check is pending. I hired an attorney and filed case against governmnent.

On September 27, I was told by US Attorney's office that my background check is cleared.

I was asked to get my 2nd FP on October 25th and is done.

Now I was told by my attorney that Immigration is not willing to expdite the process and I know probably due to following reason.

My ex-wife placed my name under Interpol site as wanted in India and may have sent this info to immigration office as my name appears in internet showing my case is pending in front of federal court for N400.

I have lost all my hopes of becoming a US Citizen and chances of seeing my son whom i have not seen for last 7 years.

If any one had any similar experience please give me your suggestions.

1. Did you withdraw the case without getting a oath date? If so why was that?

2. Your jumping to conclusions here.

No doubt pending case can be a ground for delaying oath. But if your background check is done that should suffice. Please post more details so people can help you.

Did you take dowry? If you haven't, then hire a lawyer in India to fight the allegations.
In any case involving interpol is a serious business and the USCIS will be obliged to extradite you. Remember that US and India have an extradition treaty. In any case, I would hire lawyers and prepare for any eventuality. Also arrange finances for the impending legal work.

Good luck if you really didn't take any dowry, if you did, then no sympathies from me for carrying on a ridiculous and illegal social custom.
 
I have not taken any dowry. I have all the e-mail proof showing she preplanned all this to get money and immigration benifits from me. This is done to get the custody of my son by harassing me.

I have hired an attorney in India but what is the use. If I go back to contest the case it may take years to finish the case.

Also, FBI knows about this and i have spoken with them in 2006 and gave them all the proof about what my ex-wife is upto.
 
Why don't you countersue her. You better get good lawyers in India and US, someone with a bite and big guns. You have to be very proactive. Money shouldn't be an issue in clearing your name. Better be broke than in prison or deported!

First off, you are assuming things which might not be true. How can you say for sure that your wife placed your name under Interpol system and that she might have sent negative information to USCIS????????? Do you know all this for sure? Even if she might have said this to you, yet still it doesn't mean she can do this.

Secondly, you say that your ex-wife placed your name under Interpol site as wanted in India then you should know that your wife can NOT place your name under Interpol system or any other law enforcement system; rather it's the law enforcement agencies are the ones who put people's name in there who are wanted.

Whatever going on between you and your wife is a family matter unless there is a criminal case is filed/pending against you in India under dowry allegation. And even if there is a criminal matter pending against you in India, yet still it cannot be entered into Interpol system. Interpol system is reserved for MOST wanted people.

You will hear soon from USCIS to take the Oath. Remember, you are told that background check on you has been completed. That means, if you were in the Interpol system, you had been detained by now. Don't assume anything. USCIS doesn't get involve in a family dispute. Whatever your wife has alleged against you in India is just an allegation so far. Nothing has proven to find you guilty. Anyone can allege anything against anyone. The second FP just recently asked from you, so keep some patience. You will hear soon from USCIS to take the Oath.

I have not withdrawn my petition. My case is still pending in federal court and my attorney has given them until december 31st to expadite the process.
