Simultaneous 140 & 485 filing

The immigration lawyer I spoke with said that if I file for I-140 and I-485 simultaneously, I can move to a new job if the process has been pending for 180 days. So far so good? This was from outside counsel and my current applications are being done thorugh corporate lawyers. How can I convince the company lawyers to do a joint filing? They might suspect that I'm looking around and it could jeopardize my current job. I need a strategy ;) .

Hmmm.... Well, this thread indicates that the 140 has to be approved first and then the 485 is filed. Or is it that both can be filed simultaneously but the 140 is almost always approved before the 485? Ahh, the confusing continues......

Oh what do you know, no response. :( Ok, so with my lazy research I guess the I-140 filing could get approved within a month. Good stuff if true. So, I can continue with my plans to backstab the firm I work for.

***Update***

Ok, this thread tells me that I can file both and I am portable as long as the I-140 is not rejected or withdrawn. 6 months should be enough time to get that I-140 approval, right?

Hey Curare, thanks for the responses.

Smart enough

I think you are smart enough to find out the answers yourself :) ........but seriously, sorry to see you sturggling for a response wished I could give a reliable answer!

Saw your response on your thread, so you've helped me out a lot. Thanks! Also, I realized that there is a whole section dedicated to concurrent filing, which is where I should have been looking/posting. I was just post padding. :D

Usually there is no problem for you to have the company laywer
file concurrently. In fact, much more people are filing concurrently.

IMHO, you're naive about the suspicion issue. In general, they
already assume all employee look around all the time.
In my case, I openly asked a lawyer about the portability
in the presense of my manager and the director of our whole
division. That was kinda extreme(aive in opposite way) but
I have kept my job for 3 years after that...

Good luck,
fdfd
