I met all condition of AC21. I 140 approved (do not have copy with me) and 485 more than 1 year pending.

company used labour substitute for me.

I donot have I 765 A or B which describes your duties at time of filing labour.

and do not have time to get it from FOIA

question is

Any Risk joining new company ? Job title will be same DBA

( however I have one form which this company asked me to fill for 140 describing my job describtion in earlier and current company.)

My case is very similar to you but I maintained good relationship with my old company and they gave copy of approved labour and I140 approval.

In your case I suggest you hire good attorney and and file G-28, your new attorney can request all your documents from INS, labour details 140 etc.,

If the job title is the same and the duties are the same, then you should be fine. I wouldn't spend time or effort on an FOIA request for the Labor Cert papers.
