I qualify for AC21 portability. Following are my questions

1. My labor mentions me as Programmer Analyst and job description has MFC and COM. Right now I am working in C# and .Net. If I a take new job in C# and .Net will there be any issue, since the technology is different(more latest)?

2. What are the risks in taking a W2 contract position instead of salaried position.

3. Is there is a possibility that INS ask to give additional documents from the new employer, since most of the employers have no idea about EAD. The only question most of the employers ask are you eligible to work for any employer. So If we need more documents later, there could be a problem.

4. Do I need to proactively inform INS that I used AC21 or wait for the RFE?

------ You need Programmer Analyst job description MFC and COM or can you corelate C# and .Net ? better if you get the new employer letter for future permanent job offer with same job title and with SAME skills as on LC ( to avoid problems)

------ you can join new employer with H1 transfer or with EAD. if you need to use AC21 with new company you need to inform them that you WILL NEED a letter for future permanent job offer with same skills as on LC, if they are ready to give you letter any time then only join them if they are not ready to give you job offer letter to use AC21 then dont join them.
4. Do I need to proactively inform INS that I used AC21 or wait for the RFE?
------I will proactively inform USCIS and send my Intent change letter+ new employer letter so that USCIS knows that you changed employer, many belive in sending the letter when they get RFE ( RFE will go to lawyer who filed I-485)
