Similar Job (AC21)

Guys, any idea if by any chance following two job descriptions could be considered similar jobs by INS, allowing me to use AC21.

1) Staff Engineer (my curent position):
Wireless communication software development.

2) Wireless Development Engineer (I might get this opportunity in a different company):
Evaluate wireless chip set vendors and associated systems engineering, along with project management.

Please share the views.

This delay in GC process is indeed impediment to our -
a) career growth : can't move up in ladder till GC is approved
b) personal growth : not in a position to buy a house till GC is approved (allthough no one is stopping us to do this, however a sense of security is must before investing $350+K)

redforgreen, do you have your own lawyer ? If yes, what does he think ?

If you get a smart enough lawyer, or even a comptent one, he can easily explain that the two positions are same or similar to the INS in an RFE. Or even if he lets you articulate on the smiliarities of the positions, and forwards that to the INS , you should be ok.

Sometimes, I think in the AC21 cases, it is equally important to get a right lawyer to represent you.

I will go to lawyer, and discuss same, to checkout what he says. Just want to be careful though, as some times, lawyers may screw your case.

On the other note, when I was typing my earlier message and wrote that I may get an opportunity, I got a phone call from, informing me that they are willing to extend me an offer.
 
I think there is well defined process which INS uses to ensure similar job description while using AC21. I've heard they use some kind of database. Please share if any one has any info on this.

Seriously though, you may be thinking about occupational category codes. You can get more information on this subject from the dept. of labor website.:)
 
cmr, thanks .... I did look at the site, and well my case may fit in "similar job description", appears its not "same job description".

Sankrityayan ....well you are right, "well defined process" and "INS" doesn't sound right, in the same sentence. I don't know what I was thinking then.

The new position is indeed very appealing. I think, I had enough of "software development", and its high time to look for some more/other (business/management) responsibilities.
