Hello People,

I need your help on Advance Parole.

My wife is leaving to India at end of this month. AP is valid till 9/16/2003. She will be returning in September 1st week (She will carry 485 receipt, EAD Card and all the documents which were filed along with 485).

My questions are:

1. I have changed job using AC21 (did not inform BCIS yet). Does it impact in any way?

2. I heard I-94 will be valid till the AP expiry date ? Is there anything I need to do cause I-94 will expire after a week from her avrrival ?


I have an appointment with a lawyer tomorrow evening and I will let you know if anything important from that meeting.

Nope.

I think they give you a new i-94 when you come back. But frankly, since I've come to USA, I have never gone back .. so I don't know.

What I do know is that a friend of mine, got a wrong date on his wife's I-94 .. and then to get it fixed later was a royal pain in the butt.

Do you know till when the expiration date they issue ? Is it the expiration of AP or something else like a year ?

If it was h4, technically it should be till when H4 expires.
AP I am not sure. (Never been in that boat), I think 140 would know better.

It is true that I-94 will be valid till the AP Expiry date, but it is not a problem, same thing happened to my wife when she came from India, I talked to my lawyer, they said it is fine. So long Ur AOS app is pending, U r in in status
 
AP is usually stamped until date of validity, which means your I-94 will also get the same date.

It is not an issue if your AP expires a week after entry. As long as your wife is under AOS, she is safe.

As long as your AC21 is concerned, that should not pose a problem since the officer at the port of entry will not be in a position to issue RFE, check etc. They will just check validity of AP and that is all.

It would be a good idea to apply for renewal AP in the time being though!
 
Don't worry about I-94 date, since your wife is under AOS ,

Your wife should be OK till she has valid AP and supporting docs, at POE they wont issue RFE
