Should I send my Passport to St. Louis for Stamping the H1 extension or I will be in trouble if it is taking 2/3 months and I may get I-485 approval( I am thinking postive)

Guru's need your advice on options available.

I would suggest that you apply for AP (if you do not have one) rather than Revalidation. The advantage is that the passport will be with you and you could go for GC stamping rightaway upon GC approval. Sending for Revalidation will only delay your GC stamping if you get approved in between.

If you do NOT plan to travel beofre GC approval, then even forget AP also.

Good Luck!

You have 1 year from the date of approval of H1/H4 extension to apply for revalidation within US. On the other hand, you could get it stamped at the US consulate whenever you go to India next (it has to be home country, you cannot go to Canada and get it done).

In my case I preferred not to get a stamp on my visa because at that point of time there was news going around that some passports were lost in mail (because of anthrax scare). I have an I-485 RD of 05/Dec/2001 and I am still waiting to hear something from BCIS. I'd prefer to stick it out and wait some more months rather than take the chance to get the stamp. In any case I don't have the option to get it stamped within US since I am way beyond the 1 year timeframe.

BadKarma,

I too have not stamped my passport for the H1B visa and it has been over a year. I am surprised that it can be done even after 1 year in the country of origin. This is not to undermine your knowledge, which is greatly appretiated, but does anyone share a similar opinion?

Thanks.....

If you are not planning to travel then do not bother with stamping for H1.

The one year limitation is only if you are re-stamping your Passport with a VISA. You can stamp your passport - rather you HAVE to stamp your passport once you are outside of the country. So you have a time as long as the new approval is valid to get it stamped from outside. I dont see any surprise element...

If dont have to travel outside of the country you really dont have to stamp at all.... and still you can get a second approval once this one expires.

revalidation

I recently revalidated mine/family. I sent my passports on Dec 23rd and recd my pp back feb 15th exactly after 8 weeks. I have our previous entry expired on 1st april 2002.

No rush for you i believe.
