Should I withdraw my I-485 application?

Hi,

I have a pending I-485 case based on asylum since Aug. 2000. However, USCIS just approved my another employment based I-485 application. Should I withdraw my pending I-485 and just simply ignore it?

Thanks

I think you should withdraw but also would suggest you consult your lawyer..

Consult a lawyer. I am not sure if you have to; however, make sure that the approval you got is certain

You will get your gc relatively soon after cap is removed.

I held an H1 visa for two years before 2000 along with my asylum application pending. That is allowable. However, as I know you can NOT submit two I-485 forms. One of them may be withdrawn by INS.

Ask your lawyer. If you don't have one, then find one.

be really careful

I'm sure you will be careful. Sometimes i-485 application through job is attached to ONE particular job - I'm not completely sure of that . And if you lose job - remember ecomony is kinda "funky" - you could lose opportunity to adjust. consult lawyer, as everybody already told, is the best advice.

Dude, don't withdraw anything until you have a green card in your hand. It's better (and allowed) to have both I-485's pending than just one.

Sbernal is right. Do not worry. Whenever one of the applications is approved the other automatically is canceled.

A friend of mine is an asylee who got marry with US citizen. After marriage interview the immigration officer said: your Asylee I-485 application has been automatically canceled.

Jeromy, would you like to share what is the process to apply for I485 through employment.
Guys, remember one thing . Getting GC through employment is far better than through asylum. Our misery don't end on getting GC. It's just 3/4th of the journey(until citizenship) . If for some reason you need to go to your home country you r screwed. All those years of suffering and waiting goes in drain.

You are not free to "go home" even if you get your green card through employment. After all you applied for asylum and was approved for it. Your whole asylum application stay with your file.
