Should I Update reference letters for EB1-EA?

Hi,

I'm currently waiting to talk with an attorney for advice on RFE for NIW, but I'm also considering sending a new application for EB1-EA. I currently have 12 reference letter that I used for the NIW (but only one of them specifically says NIW). They are all from last year and they are all addressed to the CSC. Because now it seems that all new I140 have to be sent to NSC will I have to ask all my references to re-write the letters addressed to NSC or will the old ones still be acceptable?

Great! Thanks for the reply. That would save me a lot of time and would keep me from bugging my references again!

It doesnt matter if the letter writter addressess to TSC or NSC or CSC. Many of my letter writters had addressed to there local USCIs offices but it has not impact on my case approval. I also know from talking to Attorney that it doesent matter to which service center the letter is addressed to. Bottom line, old letters are acceptable without problem.

Althought National Interest is not that important for EB1-EA but certainly helps to prove that "the alien's entry into the United States will substantially benefit prospectively the United States".

if the letters used for NIW were written keeping in mind 100 % NIW then whenever possible just get rewritten letters amphasizing on extraordinary abilities. Keeping same letters might invite RFE for more letters.

Are these letter more than one year old (from possible date of submission. If yes, you may want surely get new one.I rememeber reading AAO decision obejecting old dates on letters.

I agree with all that address doesnot matter!
I disagree with all the NIW letter will work for Eb1-EA. Now that will also depends how ur letters were framed. If they emphasized on national interest of your work. It will help but credentials are important. I am surprised How these experienced gentlemen (NIW04, pplu, eb1doc) are commenting affirmtive without knowing your credentials.
last I agree if letters are not that old then they are fine but why send very old letters to invite trouble...........
 
I don’t think you should change the letters. CIS will definitely do some cross-check.

really do they do such cross check fo rindependent cases! i am sure they don't!

Difference between the letters signed by the same person can only let them have another reason to question you about how objective that person’s opinions are.

I beleive difference will be due to different dates! any moron will understand that!

thanks to all for the reply. My letters range in date from July 04 to probably july 05. I did my NIW on my own so it took me a long time to contact references, gather material, etc. I can understand them not liking letters being like, 10 years old, but just by a couple of years??? Also, I'm not sure on what some people are saying here on them "double checkign"? Can't I apply for more then one category if I send two independent applications, i.e., EB1 EA and NIW? Is there a problem in doing that?

YES YOU CAN APPLY IN TWO CATEGORIES USING SAME LETTERS ALSO.
in my opinion they will never do double check to the level where they will check documents. yes you may have to inform them on form I-140 that you have applie dfor NIW...thats it!!

to me you appear to have predecided thatyou are going to use same letters.....i beleive that is true and then don;t waste time in asking for opinions. i beleive your credentials must have improved by now in two years..asking few more letters will not harm. Amount of energy you want to spend after RFE ...use now........................why leave any option for RFE..do your best man!!!

Not much has changed in my credentials other than I published part of my work and I'm now working on publishing the rest. but when they wrote those letters my references already knew that.

Now, I'm sure I understand your last paragraph? are you saying that I shoudl gather these letters while I prepare for the RFE or after I'm done with the RFE?

It will be interesting to see what the attorney will say on Monday: do RFE? Switch to EB1 or do both??? I'll keep you guys posted!

but man be selfish in asking letters as it might happen that you are thinking too much about them and they will give you letters just like that.
what i was trying to say is be aggressive in preparaing petition and don't leave scope for RFE.

i used reverse
i mean Eb1-OR letters for NIW
got bad RFE for NIW
i am not discouraging you but i guess i was unlucky!
