Should I file concertment I-140/I-485 or not?

Hello Gurus,
My labor got approved (EB3) and I'm in a dilemma. :confused:

Taking into an account the implication of the new I-140/I-485 guidelines, can you please advise whether to go and file CONCERTMENT I-140/I-485 or I-140 alone?

In other words,
Is it better to file I-140, wait for approval and then file I-485?
(By doing so, I don't get the benefits like AP and EAD, on the other hand, I can file AC21 after 180 days)

OR....

File concernment=> get the benefits AOS, AP and EAD but waiting for the whole GC case approved with no possible option of changing employer.

Which way is better???

Please be noted, I'm here on H1-B such the full six years will be completed on January 2007.

I would suggest you to keep continuing on H1B until you get your I140 approval and then file I485 as its always safe to be on H1B, since you have H1B period till Jan 2007.

Concurrent filing would be more encouraged for someone who is running out of H1B period, which is not in your case anyway.

Even if you file concurrently working on EAD or switching to employers would still be a nightmare until I140 gets approved.

well if the Fuije Memo gets implemented is he not better of appyling concurrently?? either way atleast by appyling concurrently you can be eligible for AC-21 more quicker...
 
yigef, how much time you have left on your H1B?
If you have a lot of time, I would try to play it safe and go the AC21 way (non-concurrent).
If you don't have much time, things are getting fuzzier
 
but then nothing tells you that if you go non-concurrent your I140 won't be delayed and you still will not be able to take advantage of AC21

what is concertment??? is there a new way to file 140 and 485 apps?

Yep . There was memo On May 17th. What it is basically you can submit your finger prints at the same time as sending your apps. so that you don't need to wait for CIS asking for you finger prints. This is a suppliemnt to Fu** memo.

I do not understand your point. You will get AC21 benifits after 180 days of filing 485, not 140. This is irrespective of the recent F.O memo. However, if you file concurrently you may get benifited by the memo and get concurrent approval at the same time as 140.
I do not see any advantages for filing separately.

All the fun apart, your 'mis'-statement did cause some confusion. So much so that I noticed a user in murth* forum quoting your statement and asking if it was indeed true ! You had me fooled for a while too...

well... it was not my intention to mislead or give out false info.i thought ppl would see the sarcastic/humour part of it . I guess i was wrong about that..

so folks THERE WAS NO MAY 17 TH MEMO

it was just an humarious effort in trying to strech the meaning of "CONCERTMENT" which i believe was typo in the initial post of yigef which he/she also said in the later post.

The matter i believe is explained and hence is closed.

i know. ppl can't even distinguish between reality and humour/sarcasim.

we need to design separate Yoga/exercise for GC seekers ...in the lines of hath yoga ,power yoga etc..

Brigand any ideas...

don't say GC yoga you need to come up something beter than that.
