Shoplifting and H1 visa stamping

Hi,

I have H1 visa from about 5 years now. I was arrested for shoplifting a $40 article in 1996 (8 yrs back), I was on F1 visa then. I was finger printed. I pleaded guilty and judge let me go with small fine (100$).

From then I have successfully gotten multiple H1s stamped (4-5) from US consulate in Delhi. I never gave the arrest information to consulate, always said no arrests in form.

All my H1 stamps were done before Sept 11. After 9/11, I have gone and come back from India once (in 2002) on my old visa stamp, and was not finger printed at the airport

I recently got the H1 transfered to my new company without any problems and got the new I94. I have to go to India in May and will need to get a H1 stamp again. Since these days they finger print etc, should I let them know about shop lifting in 1996 ??

My dilemma is if I admit now, then all my previous visa forms are proved to be lies. If I continue to lie on the form, will they know given the fact that they didn't in my last 4 visa stamping. Please advice, what should I do.

I have no intention of applying for GC and will be going back to India next year in March.

I was in a similar situation not long ago and truthfully said 'yes' when applying for a visa in India. They did fingerprinting at the embassy and I had to wait for 4 weeks before I could get the visa and return to US. Just thought I would share this with u.

Can you describe your situation please. Did you ever said in any other previous form that you were not arrested etc. If you are not comfortable in writing to the public forum, please send me pm. I will really appreciate it.

I forgot to write in the form the first time. But this time I remembered and said yes. I was arrested but not convicted for Petty Larceny. The case was null processed.
