hello and thanks for reading im going to make this short as possible, me and my girlfriend(my girlfriend and I :rolleyes:) been together for 4 months, shes american citizen(born) and Im not, i came here when i was a teenager(13) with a tourist visa, over stayed etc..etc. im 23 years old shes 21, we do no have any children and she wants to go out of the country with me and she knows I can't, so We have been thinking of getting married, and get a new apartment until we save some money, get a lawyer or whatever , i dont know nothing about lawyers or immigration laws.

So how much do i have to pay for all this process and do i have to go outside the US to get the greencard ? how long do i have to wait for it ?

my girlfriend has been arrested for marijuana possession, I never been arrested, All i have is traffic violation tickets(driving with no insurance or license, minor in possesion of alcohol etc..)


Will they deny the Greecard or GC as you call it here, because of her record?

You application will be fine, provided your minor traffic offenses are indeed minor. In addition, demonstrating that your marriage is bona fide is critically important for a GC to be issued to you. Also, never claim to be a US citizen now or ever, because that is a crime extreme magnitude. :eek:

As for your GF, she was born and raised here, so she can be a serial killer who spend time in jail, USCIS would care less about her than your moral character and criminal behavior. In short, Americans can have crimes of enormous proportions, USCIS isn't concerned about their moral characters...:confused: So, spare yourself from any criminal mischief, and meeting all eligibility requirements with demonstrated bona fide marriage, you will be fine and approved. In my opinion, no lawyers is needed, because your offenses are minor, but your future wife's criminal past will be irrelevant, unless USCIS suspect you are in the business of "weeding", but can't do anything as you have never committed a crime. Lastly, no alcohol in car, this would ruin your future in the US, especially multiple DUI which can become deportable offenses. :rolleyes:

Approx. 4-6 months, cost is about $2000 if you don't use a lawyer. You need to NOT leave the US until you get a green card, because if you leave before the GC, you will be banned for 10 years due to your overstay.

Driving with no insurance or license and underage possession of alcohol are not minor traffic violations like speeding tickets. They could cause your green card to get denied, depending on the specific classification of the offenses and the sentencing involved. You better consult a couple of lawyers before applying ... not necessarily to have the lawyer handle your application end-to-end, but just to get a one-time consultation (and a second opinion from another) to look at the specific details of your offenses and advise you on what your situation is in terms of deportability and eligibility for a green card.
