Shall I withdraw my I-485?

Shall I follow the lawyer's advice?

Here is my case: Asylum Approved 03/2002, I-485 ND 09/2003.

I've just got married and my wife holds F-1 visa. But she has to study thousands miles away from my city. She doesn't want to continue her study and wish to depend on my case. From my previous knowledge I knew this is impossible. But I went to ask my lawyer for help anyway.

He told me to withdraw my I-485 and submit it again but this time together with my wife.

Is this really doable? Anybody with successful story to share? I really need to make a decision soon! :( :confused:
 
As far as I know, If you were married when you applied for you Asylum and then granted, you could file I-730.
I put my wifes name in my application, and I called the USCIS CS. they told me I-485 is just for me and no one else,. So I dont really know if its going to work,there are more people on this forum which may help you with better info.,

No No No. This will not do any good. For asylum cases, the determinative date for derivative status is the date of the asylum grant. If your two are married after the asylum grant, she cannot derive anything from your asylum status. You can file an I-130 for her after you get your green card and after that it takes five years for her to complete the process. Refiling your I-485 will not do anything other than delaying your green card approval and her I-130 process.

Your lawyer wants to kill you buddy.As I said in one of my previous posts,be careful with lawyers.In most of cases,lawyers makes us wrong.Don't do this my friend it's not gonna help.It's gonna delay your process.Keep your wife in your house and she's not gonna be the only one person to be illegal in this country.The most important thing is she's already in US with you.Do whaterever you can do together with your wife as any other lovers.Take a time and get your GC.Once you're PR,fill out I-130 for Her.If it takes her 4 years to get a visa ,it's better than nothing.For 15-20 years,Millions of illegals in this country are still looking for the way to be legal.By the time,you may also become a US citizen and if I-130 based on GC doesn't help,you will have to fill out I-130 for her as a US citizen and based on this case,she will get her GC in a year as other illegals do.YOUR WIFE HAS TO UNDERSTAND THIS:Love first and documents behind.
