Sevis data update on I-20 expiration

I have a question regarding an extension of I-20 for F-1 status students. Dilemma here is my I-20 expired on August 25 2005. But this went unnoticed by me and by the DSO at my current school. Current immigration law states that any extension of I-20 needs to be done 30 days prior the expiration date on I-20. I was able to register for classes regardless the expiry date stated on the I-20. Since the expiration date went unnoticed by me and the DSO, DSO at my school went ahead and filed some petition to update the sevis information to have the new I-20 expiration date to Nov 20, 2005 which is the last day for my semester.. It’s been about 2 months since this petition was filed but the DSO hasn’t been able to receive any update on this. The Reason this question bogs is, this is my last semester and would like to know how this would affect my status and my ability to receive Optional Practical Training. I have read several posting on this forum that sevis data update takes really long time. I am sorry in advance if I haven’t been able to word the scenario correctly. Advice would be greatly appreciated.

====Your statement is not clear on when did you apply for the extension. If you did apply extension within 7/26 to 8/24, then you are in good shape, just wait for the decision to arrive, and that will let you put back in status, there is no problem with that.

And the killing time for wait, I would suggest you to go to your congress men or the senator office (most of them are in downtown area) and ask them to made an inquiry on your behalf. It will only be couple of days, you will hear something from them, your application stauts in more general terms.

====Now, talking about OPT, you may or may not get it. If they decide and turned down your petition, then you have to leave the country. They will deport you for sure. But dont give up hope, mistake happens. You may file MTR if your application is denied, and keep good faith. In order to invoke your application contact your congressmen or the senator, at least you should get an RFE.

Q: How do I request an F-1 program extension?
A: If you are an F-1 student and need a program extension you must apply within the 30-day period before the expiration date on your Form I-20. For example, if your current completion date on the Form I-20 (Item #5) is 5-31-2003 then the earliest you can apply for an extension is 05-01-2003. You must apply for an extension prior to the completion date on the Form I-20 or you will fall out of lawful F-1 status.
