seventh year extension

Hi

My friend has a typical situation.... is there any one in the same boat?

He went to india due to personal problems (monther expired) for almost an year.. and got his stamping for extension of visa in India( for last year on his 6 years of H1 allowed period).

His stay is more than 11 months now in India... now he is coming back to USA.

I heard there would be a 7th year extension problem if u stay out usa for more than one year.. is it true?

IF so is it better start before he completes a full ONE year stay out side.

Please put some light.....

If he is in US then he can also recapture the time spent out of USA and is also eligible to file 7th year extension IF LC pending more than 365 days or I-140 filed or I-485 filed
