September is here, what are my chances for allocation of Visa #

My wife and I both got code 3. I'm not sure why they even have the multiple types.

How do you clear name check(self)?? On your earlier point, how is it possible for USCIS to stick to the priority date if different people are in different stages of name checks etc. As of Sep31st, USCIS should use whatever visas it has to whichever application clears all the checks and hurdles. If they stick to priority dates they might end up wasting visa numbers. This is all conjecture as I do not have any fact to support the argument.

I don't think so. With the cutoff dates for EB2 and EB1 being in Jan 2007 for most countries (as in the Sept bulletin), they should have enough eligible pending cases to use up the remaining visa numbers without having to violate the priority date rule.

I always tend to agree with you. I believe they have to respect the pd. I dont know, my case has been processed very weirdly from day one. I never got fp, my husband did (code 3); after talking to IO she sent (twice) fp notice for me (said due to glitch on the system never generated one for me), but they were only code 1.

The IO said NC is cleared as of 8/29
 
Techbuyer,

Things are moving for you. For me I haven't received any LUDs since last time.

I'm keeping my fingers crossed and will let you know.

On trackitt it seems that some of the guys that got LUDs are starting to get approvals.
