Question regarding I-140 & I-485

I-485 Info:
RECEIPT DATE: SEPTEMBER 11 2002
NOTICE DATE: SEPTEMBER 21 2002

I-140:
NOTICE DATE: SEPTEMBER 21 2002

I765: (EAD)
Got approved on November 21

I131: (FOR TRAVEL) -- Advance Parole
Got approved on November 22

I have filed 140/485 concurrently and my question is, if my I-140 is not approved and I lose my job exactly in 6 months from the time of ND date of my 140 & 485, i.e some time in March'03. Will I be still elegible for that 6 months rule on I-485.

I mean there is a law right, which says, if we cross 6 months on 485 then we will be safe if we lose our job. The confusion is my 140 is still pending and can I use this 6 months rule????


Please help me....

Per my understanding …INS is working on this issue for concurrent filers. We are not eligible to use 485 portability, I 140 approval is must....

may be you can check with lawyer for accurate info
