Sept/Oct 2000 case(for CP but applied I-485: Approved on 11Mar02

My case was approved (according to AVM) on 11 Mar 2002. My wife and two kids were also approved on the same dates. My details are :

NSC/EB1/EA/I485
RD 09/22/00,
ND 10/18/00,
FP 03/13/01,
EAD(renew):01/02,
FP:08/01
I140 approved(08/00) for CP(Mumbai); did I485 instead.

I called Congress man on 18 Feb. Their office told me after two days that Nmy case is still within the time limit and I should wait for another 90 days. If within these days, the case is not approved, I should contact them again. So, it seemed useless for me.

I had called IIO at NSC about 5-6 times starting from November 2001 and everytime the answer was different and without much meaning.

However, when I called them on 8 March 2002, the IIO said that my case is on way for review. I asked what does "on way for review" means and is it same as assigned to an officer. She said that she can only see this information on the computer. On further asking to elaborate, she told that I ma get RFE or FP notice or the officer may want to see my I-140 petition. Therefore, she told, she cannot give me any time frame about getting any RFE/approval as each I-485 case is different and it goes through quite different steps. That was all about our conversation.

Even the IIO did not told me, I had an inkling (judging by all the discussions and informations on this board and hence adding 2 plus 2) on that day that my case is assigned for adjudication and I thought something will come in March 2002.

To my surprize, the approval came within 3 days after that conversation.

I now think that the IIO told me the application is "on way to review" but it mat have already gone for review(for adjucation) already may be 2-3 weeks ago. I also infer that the computer does not show much information about each step of precess and it merely says few workd for each step. IIO interpretes them according to their knowledge and judgement and hence we see different answers.

Thank you all for such a wonderful support in this board. I was a regular visitor for almost 2 years. I wish all who are waiting, best of luck. SPecially to those, who are of 2000 ND, I wish them early approval.

ne idea when ur I-140 case file was returned to INS/NE from US Consulate in India.

I never asked about my I-140 to IIO nor I mentioned it to the Congressman.

Everytime I called IIO, they said things are fine with my file.

So Iam not sure whether this CP thing was the main cause for the delay or not.

Some points about my I140

When I recieves the apporval for I-140, it mentioned that my file is going to NVC and they will do further actions. I called NVC and talked to one person about my intensions to submit I485. He said me to go ahead and submit it and I need not have to do anything about CP. So, I dod just that. I also got the Packeet III from NVC which I ignored (the NVC person told me to ignore it).

After that, I dont know which route my I140 traveled.

My Hearty congrats to U and your family on the approval of I 485 . Mine is a very similar case like yours.I 140 approved for CP, nor me nor my attorney have asked for it. But mine is EB2, India. After 540 days of waiting in I 485 stage, now INS is asking me to file for I 824 form ( application for a duplicate approval for I 140), my attorney says it is meaningless, even if I apply now it will take 6 to 8 months for the approval.

CAN U PL TELL ME ANY TIME HAVE U FILED FOR I 824, CAN U PL CHECK WITH YOUR ATTORNEY. SINCE YOUR\'S I 140 ALSO WAS APPROVED FOR CP. If U can check with your attorney and tell me , I will be greatful to U.

I have not filed I 824

I have done my whole GC process by myself. No attorney or any emplyer was invloved.

I have not filed I 824 (this application is to ask for cganging from I-485 to CP and NOT for vice versa and therefore in my case and also in your case it is not needed.

I dont think EB1 or EB2 has any meaning once I 485 is filed. In fact, EB1(EA) case sometimes attracts more scrutiny than EB2 or EB3 since the former is not employer based.

In my opinion, you should be getting approval without doing anything about CP. And IIO\'s words about I 824 can be safely ignored.

However, the above is solely my opinion and acording to my judgement.

I am sorry to note that you got a written note from INS regarding I824. In that case, you must ask your attorney\'s advise. Anything documented(written things) need to be taken seriously and so you cannot ignore it.

I am surprised though, why they are asking you to file I824.

I can only say that when talking to your attorney bring out the examples of other cases which did not need I824. I am sure your attorney also had several chances in the past to come across your and my type of cases earlier and so they will know better how to handle it.

Try INS HQ

Ramukesi, I have been following yours and other I-140/CP/I-485 cases in this forums.
It is pathetic that your case has been pending for a year and a 1/2 and they are now requesting this 824 process even as others fitting the same profile with RD after yours are being approved.

My suggestion is to get your attorney to request a meeting with INS-HQ to issue directives to the service centers on a proper procedure for cases fitting this scenario.

In my case, I-140 amendment was held up because of a complicated acquisition where the acquiring company acquired only the assets and not any of the liabilites for the acquired company.
NSC indicated that this did not constitute a true "Successor Of Interest" which is the only way I-140 can be amended with a new company name.
Our attorneys then lobbied for and setup a meeting with INS-HQ, convinced them regarding the fact that the acquistion does constitute a "Successor of Interset" in the true interpretation of the law and got them to issue directives to all Service Centers to adopt these standards.
Once the directives were issued, we received I-140 approvals in 2-6 weeks.

Guys Correct me if I\'m WRONG....

You need to file I-824.

If your I-140 was approved for AOS (I-485) and then you decide to go for CP.

You file I-824 so that INS and/or NVC will send your I-140 case file to the US Consulate in ur home country, and you proceed with packet III and IV stuff.

Hey Ramu Y the HELL do they want you 2 file I-824... I still don\'t get it (based on my limited knowlegde...)

Not for genuine case

INS is committed to approve the cases only for Mr.Hijakers, not for the genuine cases......
