I have notticed that if you have concurrently filed then your 485 ND is taken into account. If your 485 ND is in Oct then it does not matter if VSC is processing Sept, yours will be approved when they start processing Oct. Most of the 140 approvals I have seen
fall into these categories:

1. EB2 etc.
2. EB3 with 140 ND in Sept or earlier, with no 485 filing.
3. EB3 with 140 ND in Sept or earlier, with 485 ND in Sept or earlier.

Show me a case where a 140 with ND in Sept was approved for which there is a 485 of ND beyond Oct ?

When you say that the logic is no quite correct, Was your 140 approved? If it did please tell us the Approval Date for your 140.

I understand that this is not a confirmed theory, we all just like everybody else are trying to make some sense out of this mess created by INS. Atleast if can ascerain some sort of a pattern even though it may not be 100%, it eases the wait.

So tell us your approval date? As according to our theory your 140 approval should not happen untill INS is processing Jan 03.

Thats a EB1 case !!. Congratulations, WangX. Pattern we have been discussing so far is for EB2 and EB3.

There may be an exception for EB1 as that catagory is too much lagged behind OR there may be IIOs just pulling applications from some where and approve 'em. It happened time after time, no wonder.

We all, together, will try to figure out the pattern to the possible extent. If there is not a pattern nothing to lose, but for killing some time while we wait. What else we can do while BCIS is not an answer for anything?.

I agree with Sanga, lets keep patience and analyze every new approval to figure out if there is any basis in our theory.

No I did not loose my patience. There are people who have applied in Jab and Feb are getting approved. They are not considering 485 dates. They are just approving I-140 cases of September. (There are two or three examples for I-140 was applied in May/June/ July and applied I485 in September. Even we are having similar number of cases for Jan/Feb 2003. Consider them as exceptions.)

There are 96 Cases from May 30 Still pending as of today. say 50% of them might have applied for 485 in Aug and Sept (first two months concurrent filing) They should get approval now. But none is coming out.

My I-140 got approved on June 7.

Here are the details:

ND: Sep 9/02 - EB2 Labor Substitute. Approved on June 7/03 ( No RFE)
I-485 MD: DEC4/02 , ND: Jan4/03 EAD,AP approved in March
