The backlog reduction efforts of both Citizenship and Immigration Services, and the Department of Labor continue to result in very heavy demand for Employment-based numbers. It is anticipated that the amount of such cases will be sufficient to use all available numbers in many categories. As a result cut-off dates in the Employment Third preferency category will apply to the China, India, and Philippines chargeabilities beginning in October, and it is possible that Mexico may be added to this list. In addition, it is anticipated that heavy demand will require the establishment of a Third preference cut-off date on a Worldwide basis by December.

The amount of Employment demand for applicants from China and India is also likely to result in the oversubcription of the Employment First and Second preference categories for those chargeability areas. The establishment of such cut-off dates is expected to occur no later than December.

The level of demand in the Employment categories is expected to be far in excess of the annual limits, and once established, cut-off date meovements are likely to be slow.

The above is very true. The unplanned and stupid way in which USCIS has approached "back log" reduction has almost guaranteed tough times for Indian and Chinese filers with recent PDs. They have used up all the available visa numbers for recent cases and neglected thousands of old cases. All they can do now is retrogress the date in order to make the situation look better than it is. The bottom line is that the next few years are going to be tough for most EB3 filers (especially Indian and Chinese citizens).

I am just waiting to see what the next visa bulletin has in store for us EB3s.

I have search the web and gone everywhere, and I guess that Oct02 will be the most likelly scenario. But we are not in the business of prediction, lets follow POJ example and pray a little.

Although I wish I could predict what the PD cutoff date is going to be, Da_BorderKid is right in that its impossible to tell. I am hoping to see Oct 02 because they seem to have finished up almost all of of the pending 2002 and prior cases. Lets all hope its as far into 02 as possible.

I am truly sorry to hear that your 2002 case is still pending. There are always exceptions to everything the USCIS does. I am sure there are quite a few people from 02 still out there. The USCIS has just neglected these cases and has based all the good news on the majority of cases that they have not screwed up. I hope your case will be one of the first to be approved in October.

My case has been badly abused by the TSC and I can totally understand the frustration this brings. Hang in there, our day will come.

My PD is 11/2002. With a Verbal Approval and a Closed Case at the Interview.

I Pray that the cut-off date is after 11/2002.

Well, how can EB3 starts with Unavailable as new quota available just starting from oct? I think it may retrogress (with cut-off date) but can't be unavailable in Oct itself...but may be after 6 months or so...

Read the bold part of the following paragraph.

5. On the chart below, the listing of a date for any class indicates that the class is oversubscribed (see paragraph 1); "C" means current, i.e., numbers are available for all qualified applicants; and "U" means unavailable, i.e., no numbers are available. (NOTE: Numbers are available only for applicants whose priority date is earlier than the cut-off date listed below.)

I would be very surprised if EB3 visas are still unvailable in October. The date will be somewhere in 2002. The only fear is that visa numbers may become unavailable very soon so lets all pray that our cases don't get stuck in name checks, RFEs etc when the visa numbers do become available.
