Well, hope you get your 140 cleared soon. Good that the attorney is putting your employer to work for your RFE - I hope it is a good sign.

RFE Not yet replied. Looks like another month. Employer is still preparing some more documents as per attorney's advise. Attorney was not happy with the documents given to him earlier.

regarding priority date and its use. The user's 140 (RD sept 2003) has been approved and the case's priority date is Nov 2002. I think the SEPT 03 140 cases that have not been approved yet so far as the priority date is much after the 'XYZ' priority date where XYZ is some unpublished internal to USCIS priority queing date.
The only way to test the theory is for Sept 2003 cases to post their priority date (the date when Labor was filed).

My I-140 is still pending; I will probably attend college full-time to keep my F1 status. This will be very expensive for me. My lawyer said as long as I have the I-140 pending, my legal status will be fine, and I don't have to have an F1 visa for back up. Even if I don't get approved for I-140, the worst situation is that they request more information, and I would have 3 months to resubmit more material.
Should I go to school to keep my F1 status or I should rely on my I140 pending status?

Looks like there's a typo with I-140 LIN# (LIN04115*)..should be more like
LIN0401*...
