Senior Members: Can I-140 be filed with both EB2/EB3 if labor is EB2 ???

A. I have an EB2 labor applied. I have a BE degree with 10 years experience which satisfies the labor reqt. So can I make my company file I-140 with both EB2 and EB3 since EB3 is currently moving much ahead in VSC.

Is it technically possible to do so ??

B. Can two companies file two I-140's for me at the same time ( the company that I am currently working in and some consultant that I plan to work in the future ?? )

Is it technically possible to do so ??

Yes. But if you opt for consular processing, it's not worth it. VSC is processing EB3s soon but the EB3 quota is dwindling and priority dates are suppoed to regress soon. so you'll have to wait anyway.

Yes.
 
If you are planning to apply two I-140 usually it is suggested to apply one I-485 and other with CP option.
What are the labor dates for both of them? You can apply I-485 with EB3 one. So even if the date retrogress it will not affect you accept it takes the longer time. use EB2 labor to apply with CP option.

Once I-140 is approved for either EB2 or EB3 you will be able to claim older priority date.
 
Can I keep both CP and AOS within US as an option in concurrent filing ??

I have another quick question ?? Is it possible to opt for CP as well as AOS within US at the time of 140 filing. ??? I am new and this could be a very basic question for you guys. I mean to say that can I change to CP at some point , if I want to , in case I feel the adjustement of status in US is taking a long time
