Seems like RFEs relating to I-140s are taking much longer

From my quick reading of messages regarding I-485 approvals after RFE, it seems like I-140 related RFE responses go into a separate pool and take a lot longer. What is really upsetting me is that I am in this situation despite being self-petitioned. Stupid INS made a mistake during I-140 stage and sent me an approval with the employer as the petitioner. Upon pointing out the mistake they rectified it and sent an amended approval notice. When it came to filing I-485, it was the lawyer\'s turn to screw me. She filed it with the wrong I-140 approval notice without enclosing the amended one showing self-petition. If my approval doesn\'t come within the next week, there is little hope of getting it before year\'s end (audit, new H-1s etc.)

Yes. There are few applicants waiting for their cases to get approved with I-140 redo RFEs. I am one of them. My RFE was received on July 25th by the INS. But, no news yet. My lawyer sent a new I-140 with the current company name( because of merger). I haven\'t seen any appovals yet. Waiting, waiting .......

akp, Does that mean you processed a (completely) new I-140? Or an amended one? Again, have you just filed for it or did you get the same approved? If so how much time did it take? Please give details. Thanks in advance....

My lawyer filed a completely new I-140 appication with the new company name as the petitioner. The RFE clearly said that
if your company merged, then you have to file a new I-140 with that company and you can send the completed I-140 application with this RFE form.
That\'s actually what my lawyer did. I do not know what an amended application is? He attached official documents which showed my old company merged with the new company. He mailed a completed I-140 with the necessary documents and the RFE on July 19th. They received it on July 25th, though the message did not change.
I just talked with the IIO (08/25/00). She was very patient and looked into my case. She confirmed that they received an amendment to my application on 25th July. I told her that the RFE asked me to file a new I-140 due to the company merge. She checked something else. Then she said that as my PD is 07/97 (which I think she got from some other records), the I-140 should get approved soon. She said that the RFE and new I-140 goes to the same officer who issued the actual RFE. When asked how long more wait could it be, she said that my 485 could get approved anytime. I do not know what to make out of it, but at least I am hopeful after the conversation.

Just called VSC and talked to an IIO (her name is Debbie). She was quite nice but was unable to provide much information beyond saying that it could take between one to two months after receipt of RFE to receive a decision. When I mentioned that I have friends who filed both their original I-485s and responses to RFEs later than I did and have received their approvals, she said that to receive such a quick response to RFEs is quite unusual. The only positive thing she told me was that the coming audit should not slow them down beyond 5 working days, i.e. adjudication will not come to a standstill for the entire month of Septmeber.

Tahnks a lot, akp. That was really a big help. I am in a similar situation in the sense that my company has merged (and subsequently sold), but have not heard anything from the INS so far.... Hopeing for the best, but once again, THANKS A LOT.....
