One of our employees is highly educated and not from one of the terrorist countries, yet his case was chosen for security clearance.
- First of all, what kind of cases are picked for security clearance?
- How long should we expect it to take?
- And most importantly, is there anything we can do for him? For instance, us (employer) writing a letter will help?
This employee is from the Philippines. After obtaining an MD in his home country, he attended the State University of New York and graduated with a Ph.D. Went on OPT when he started with us a year ago. We applied for his H-1B back in April this year. With his OPT being about to expire, we requested expedited processing of his H-1B for an additional fee in early September. We then finally heard from them but that his case was sent to security clearance.
His OPT was initially going to expire in the end of August, but they granted one-month extension in no time after he requested it. Right now, we cannot put him back on our payroll until his H-1B is approved as the extended OPT has expired in the end of September.
He does cancer research as a post-doctoral fellow, and we are one of the very well-known medical centers in New York City.
Is it because of where he is from, what he does professionally, or his employer? We are surprised by this because we have good standing with the USCIS and H-1B applications for other employees have been approved.
We are exploring options that are not necessarily in the standard protocol. Please let us know if there's anything we can do to get him back. Thank you.
