second RFE?

Although long pending NIW-140RFE repsonse (NIW140/485 FILED ON 5/2004, RFE RESPONSED ON 8/2005), I just received this weird e-amil, saying "On February 13, 2006, we mailed a notice requesting additional evidence or information in this case. The notice explains in detail what additional material is needed. If you have questions about the notice, what is required, or if 14 days have passed and you have not received the notice, please call the National Customer Service Center at (800) 375-5283."

What does that mean? Does anyone here have same experience? I am so nervous!
 
So sorry to hear that. I can understand your pain. Looks like they need some more evidence. Dont be disappointed. Its probably good news since they did not deny the petition. Hope for the best.
 
Thank you for your comfort. I am very sad now. It has been too painful, almost two years, thinking that everyday. I konw I am wasting my life. I could not figure out what would be for second RFE? Never heard that before. I had 7 first-author English papers, couple award, reviewing papers, memberships, 11 letters (6 independent) in the first file, 7 letters (5 independent). I am so sick on asking more supporting letters.

Does anyone have that experience?
 
After submitting 11 letters initially and 7 for the RFE, I know exactly what you mean when you say you are sick of asking for more letters. What was the original RFE about ? When you spoke to the senators etc did they give you any reason / hint about why your application was delayed so much. I am thinking its probably a simple RFE. Since its been such a long time since you applied..maybe they want to make sure that you are still working in the same field of NIW or something like that. My friend got an RFE like that.

Do you mind telling me what your field of expertise is and details regarding your petition ? I read most of your previous posts but could not find your field details.

I will pray for you. Hope for the best and dont be so dejected. Life is much more than the US GC.

My Ph.D. degree was in Pharmacology in so so US university. 2-year Post-doc is in top US university. As I said, I have 10 English so so papers with 7 first author. I have best paper award from top conference, inviting paper reviewing, and editor for a Chinese journal. But my citation is low. All my supporters are either chairs, directors, or deans. I really think they are the big guys in my field. My case was filed by the attorney.
I contacted the senators for the long pending. One congressman just sent me response e-mail saying the long pending might be due to the concurrent 140/485 filing, affected by the factors of fingerprint, name check.

That is it! I am not optimistic any more after this long painful waiting.
 
Anybody has an idea if in such a case you are able to reapply before your application gets rejected? Can you drop this case and file the petition again? I'm saying this because I found out the the whole NIW is extremely subjective and it depends on the person who looks at your application and what happened to him/her the nite before the review!!!!! Honestly, how can there be such a wide range of variability in credentials of people who got accepted and rejected based on NIW?!?!?!? I have friends who got accepted with only 2 papers (one published, one in press) just 6 letters 3 of them from directly related people and then nothing!!!! I think the best choice is to reapply!
 
Actually, thats not a bad idea.....But if the second petition is based on the same credentials / reco letters, wouldnt CIS check into the earlier petition? If its with a different consulate, then I think one would not want to worry about it at all. I remember reading on this forum that somebody tried it and got approved.
 
I could reapply, however, 485 can not be resumbitted because of retrogression. I am thinking I need move to another center and resubmit.
 
Sorry for your case. I have heard from different sources that too many letters (>9) will hurt your case instead of help. CIS officer would think that why you sent so many letters is because you didn't have other good things to show him. Normally, 6-8 letters are enough.

Numbers of letters will not hurt petition.
however the content will.
"CIS officer would think that why you sent so many letters is because you didn't have other good things to show him" This is Not true at all...........The letters essentially are not tipical recommendation letters but letter of support which analyse your work from national interest point of view and ur expertise to do that.......which is all based on ur resume.......

My attorney just pasted second RFE to me. It is very strang. The officer did not mention anything about my response to first RFE reponse, which included 5 independent supporting letters from big guys. However, he ask me to provide very specifc evidence about my orignal application. You can see what they want as below. The problem is, I graduted in 2003, submited NIW140/485 in May 2004. My previous Ph.D. advisor had grant before I joined to his lab, so no my name on it. Also, very unfortunately, he could not got grant again. I guess his grant was until 2002. What Should I Do? :confused:
My current post-doc advisor is well funded, but no my name on it too. Since they only ask for previous fund, is that possible I can argue with them with grant in the current lab? I am so sad. I just think I spend too long time on this, and now I am exhausted!

Please help!

A letter by XXX (My previous Ph.D. advisor) contains the claim that alien petitioner’s “work is repeatedly funded by grants from national organizations.” Acceptable evidence includes copies of relevant portions of at least one grant or grant renewal approval notice which names the granting authority, at least briefly describe the approve project, names the principle investigators, specific the duration and amount of the grant, names the alien petitioner, identifies the alien petitioners’ position on the project team, and specifies the amount of time to be spent by the alien petition as equal to or greater than 50%.
