My case is as follows

I140/I485/EAD/AP RD: 05/12/2004
I140/I485/EAD/AP ND: 05/18/2004
FP Done: 07/23/2004
AP AD: 07/22/2004
EAD AD: 07/22/2004
I140: RFE on 09/1304
RFE sent on 11/12/04
RFE Received by them on 11/16/04
LUD changes 12/07, 12/09
Second RFE on 12/14/04
I485 : LUD on 10/27/04
I140/I485: Pending
CSC
The First RFE was about W2's ,Company's tax statements, and my own Paystubs and so on.
I am not sure what this second RFE has.
Did anyone get second RFE on I 140. If so could you please post the details

i got 2 REF on 140 similar to your case. first REF on w2 and company's financial documents. 2nd REF on full tax returns of the company etc.

my 140 and 485 approved after 10 days of getting 2nd REF documents.

so nothig to worrey at all.

EAD/AP approved Jan 15 th 2004
RFE on SEP 21 st 2004(Company financial audited statements and w2 forms of mine 2001/2002/2003)

My attroney responsded and they received the response on Nov 23 rd 2004 :confused: almost same stage---fingers crossed

I have received a similar RFE. They are asking for company's federal tax returns and my W2 forms. Do you know if the company tax returns you sent were simple copies or is there something special that needs to be done (like IRS attested returns etc.)

guys,

first of all getting a 2nd REF is not a very very serious issue as there are many people who are getting 2nd REF on 140.

i got first REF on 140 where INS requested my w2 forms.
after getting those, INS sent 2nd REF requesting for company's financial details.

2nd time my lawyer sent all last 3 years tax returns, annual report a cover letter etc.

if the company is public, you can get annual report easily. i don't know about non-public companies.

after getting documents for 2nd REF, INS approved my 140 and 485 within 10 days.

My attorney send me a copy of filling to me: in the response he said

X company was acquired by Y in jan 2003(which is a public company) however still operates as wholly owned subsidiary, for your referemce we have enclosed a complete copy of acqusition as wells as X company's 2001 and 2002 audities financial staments, to establish the petitioners current ablity to pay the beneficary wage we have enclosed Y 2003 audited financial stament. Y statment was audited as PARENT COMPANY AND NOT AS AN OPERATING SUBSIDIARY COMPANY(I.E x) also we have highlighted several of the acquistion refrences found in the financial statment. For futher questions please dont hesistate to contact xyz, cfo phone number

Do you forsee any problem an btw all my three years I am working with them only :confused:
 
I had 2nd RFE too. Nothing special same stuff as everybody getting, they just asked in 2 RFEs althoug it is not logical but they do. Good news is case approved almost same day they received 2nd RFE reply.

Your RFE comes quick, my sencond one came 9 months later, this almost killed my case since company was in bad shape.
