My state is CA. I and my wife went to the AOS interview in February 2010 and I thought that the interview went well. The officer did not ask any particularly difficult questions and only made one comment that we are married young (we are both 24). I thought he reason why I did not get stamped was because I got arrested in 2009 and just got a Deferred Entry of Judgment which requires me to do cal trans and community service for the charge to be dropped. the interviewing officer gave me until August 2010 to send in my court disposition regarding the arrest. She also gave me a letter stating the deadline to send in the court disposition. I was under the impression that the court disposition was the only remaining issue in my application.
However April 8th 2010 we got a letter for USCIS asking me to come in for another interview to "complete the process of AOS." The letter asked me to bring: ID, passport; evidence of my schooling in the US (I went to school here for 4 yrs); documents to support my bona fide marriage; and court disposition regarding my arrest in 2009. This letter was signed by a different officer.
The letter did not specifically say that my wife has to come with me but I am bringing her anyway. My question is: are we facing a fraud interview here? And why do they ask for my court disposition knowing that I won't have it available until August (The DA will only drop the charge comes August no matter how early I finish cal trans)? Please give me your input and advice I really appreciate it.
