I like how It's always someone with a phd or master's who allegedly suffers the most, ordinary "less educated" folks don't get mentioned at all. So arrogant. Sounds like this -" Hey, do you know who I am ? Look at me, I have a degree so I'm super smart, I deserve green card more than any of you losers, how dare they not give it to me. Weird story and even weirder people in there.
How many people have sold a property within days for the money for the application which doesn't have to be paid for until way later....the man who had his medicals taken care off while the regulations clearly are stating when you should do it.
First of all the Fiscal year for 2012 hasn't even started...so they have no claim to something they did way too early and that is their own risk. Why would any one be liable for money they spent while the majority of the winners wait until it gets closer to the fiscal year.
This is just a non sense article and perhaps the journalist was paid to write it....

Medicals are valid for 6 months, so it's perfectly legit if he has low case number.
Even in your answer it shows it is not normal...Most people will have a medical taken care of close to their number being eligible...not within days of receiving the NL. it just doesn't make sense.
Neither does the sale of property within days of getting the NL make sense...if they can sell it so fast it must be a hot piece of land and they should be happy of having received that money and now being able to put it in a savings account.
No money lost there. The DV lottery is clearly stating that money spend/paid for the DV lottery is the person's own risk, it doesn't mean that they will receive the GC and no refunds will be paid.
Basically they are entitled to perhaps some stamp refund...the rest is not what USCIS told them to do.

Agree on property sale, but medicals at that point were perfectly legit. There's no meaning in NL2 for AOS applicants, so if he wanted to make it earlier (perhaps suspected a medical condition) - it's his right, he chose it in good faith based on an official DOS communication.
But nobody is responsible to pay him back...it is clearly stated that all fees you pay for are NO guarantee that you will receive the Greencard...
maybe he will be lucky and win in July and get a low number so he can still use it...not a smart move for an educated person because there is no guarantee when a number becomes current...still a stupid move.
At the time of my friend's winning she was also very happy and wanted to do everything the same day, but at first we made an appointment at USCIS and they were very clear, just sent in the papers and wait until the Fiscal year starts. That was the best advise given....nothing is certain and even the lawyer who helped me in the past was clear....when a number becomes current is no guarantee you can only look at previous years and have kind of a clue when it MIGHT become current...
