It has been 10 years since I came as A J1 , now completed J1 waiver on H1 hit with retrogression, I had O1 approved few years ago, but chose J1 waiver for easier route , but on H1 my EB1 NIW was not approved, ( strange reasons..despite meeting the similar O1 criteria), but got EB2 NIW approved with I 140 , my lawyer sent an email several months ago that those applying thro' schedule A will not be affected by teh retrogression, from what I understand this was originall designed for RNs, Physiotherapists , but it seems even physicians are eligible for this there are some criteria however it is less rigid than a O1 criteria from the applicant, but needs some specific employment scenarios?
Can anyone who is in the process or who was successful thro' this route, explain me some details?
