The gurus have got their GC's and have moved on and you need to move on too. Any guru who was left has been taken out by this move by USCIS.

My take on July07 Bulletin.... they are going to make big money out EAD/AP business....:D :D
 
uncertainty continues

With this big surprise, It becomes more clear that USCIS does work in an inconsistent and wrong way. It proved that the retrogress in the past two years was unnecessary and wrong. It also gives uncertainty of the the current and future I-485 applicants. What it does makes obviously negative impact on the current pending I-485 applicants, and not that obviously on those soon-to-be current. Some lucky one may jump to the front of the line, but more people may stay longer. LIFO is Bad on almost every one. Only one good thing is it may distinguish you from undocumented applicants in time if an amnesty bill passes this year.
 
My take is: Don't Fall Into Uscis Trap

Those of you who are planning to jump on filing 485 on July 1st, please don't fall into USCIS trap. The best bet would be to wait till July 30th and file on that day.

Let me explain the math: Current fees for I-485 + I-765 + I131 = 395 + 180 + 170 = $745. Then from next year on until you get your GC you will basically be funding the USCIS coffers with $340 + $305 for EAD and AP for the next 4-5 years. If you file with the new file structure i.e w.e.f. 30th July you will only pay a single amount of $1010 (which includes 485, 765 and 131) and you don't have to pay a single penny when you renew it every year from next year onwards.

I have already paid close to $1450 till now on 485, EAD and AP and from july 30th onwards, if I have to renew my EAD and AP I have to shell out another $645...

SO PLEASE DO YOUR MATH AND DONT FALL INTO USCIS TRAP.

A friend of mine told me about the latest bulletin and dropped in to check out what the folks here are saying.

Whether I file on July 2nd or July 30th, I thought the extensions were going to be free. Did the fee extension memo specifically state the extension fee is being removed only for those who filed their I-485 after July 30th?

Also it is quite risky to file so late. In case things get delayed or you find something missing in the end, it would be a disaster.

Well said !! All the GC soothsayer's who predicted years upon years of retrogression like hanging 'World is going to end' boards on their necks have been taken out by the July Bulletin.

Regardless of whether retrogression strikes again, USCIS has shown that dates can be made current for all countries and all categories.

Its great news for everyone who are in the queue and certainly bad news for these soothsayers, Employer's, certain Attorneys, certain supposedly pro-immigrant groups and others who reveled in the knowledge that it will take years for dates to move forward. These are the ones who minted money due to the retrogression.

The only 'Guru' in this whole process is USCIS.

Thus, if you file an I-485 with the fee listed above, while you will still need to submit applications for an EAD and advance parole, you will not need to pay a separate fee so long as your adjustment application is pending. However, if you filed your I-485 before this fee change, to apply for or renew your EAD or advance parole, you must file a new application with the new fee for those applications.

So the removal of retrogression is indeed to maximize the fees. Make everybody current before the fee change becomes effective, so they'll have to keep paying to renew EAD and AP every year as according to the old rules.

If they held back the dates until after the new fee structure went into effect, people would only pay the one-time all-inclusive fee, which makes USCIS lose money in the long run if the cases drag on for years with free EAD and AP renewals.

Are these ba$%^%^ really changing the fees structure? How the f.... they can do it, while we still have to pay EAD/AP renewal every year. I am going to sue these mfs. I know why they are doing it, these is regarding the new bill which they are about to pass to legalize the illegals. Why can't they grant citizenships to everyone out there. And yes why July 30th? I think politicians and uscis all have it planned.

I have not left the forum, I just visit once a week or so. Anyway, the latest bulletin is very surprising but it pretty much validates my long held beliefs/assertions that this whole visa numbers/retrogression thing is based on a LOT more than the rule of the law. To many factors such as current backlog levels, politics, budgets, selective interpretation of the law, mismangement etc go into these rash decisions.

As far as I can see, the only reason that all dates have been made current is because with the ridiculous severe retrogression imposed, they have not been able to use even 20% of the yearly quota of visas. They know that if they let 30-50 thousand visas go to waste then they will come under the severe scrutiny of the Ombudsman, AILA and Congress. Everything has been made current to "cover their ass".

The second reason is that they have pretty much achieved the goal of retorgoression. These goals were bi-specliazation, ban on labor sub, reduction of backlogs,increase in reveue through higer fees and bringing PDs within 6 months etc. They COULD NOT have achieved any of this without halting the process for over 2 years. They nicely used 245i's and the BEC backlog numbers as an excuse to implement severe retro. It was indeed a brilliant strategy. Now that they have implemented all the new stuff they have opened the flood gates.

As for PROS and CONS. Below is what I think.

PROS:

1. Everyone with an approved labor can now file 485 and get their EAD and AP. This is especially good for people waiting to file. A lot of H4 visa holders will be able to resume their careers. This is a HUGE positive out of this.

2. Everything being current gives a window of opportunity for older PDs to get approved. This will ofcourse depend on how they process. Earlier when everything was curren they went by RDs. In a lot of cases there was no order. They approved randomly. Random approvals could be a major problem in the future because like 2003-2004 a lot of older cases may get neglected.

3. This bulletin proves that we should never blindly follow any so called GURUS and their extereme opinions because there are way to many people looking to take advantage of immigrants. No one has an idea of what is going on exactly but one thing is for sure, there is no magical mathematicl formula that can explain this process. UN tried hard to impose logical math into this forum (India EB3 will take 10 years etc) and it is now obvious that it was for "other selfish" reasons.

CONS:

1. They seem to have gone overboard with this bulletin. It would have been much better to keep moving dates by a few years in each category letting them move toward becoming current in a more measured way. Instead they do what they usually do and make everything current without a thought to how the process will be effected. This can be pretty dangeours in the future.

2. I foresee a flood of applications and processing dates receding from their current state to atleast being 2 years behind. This may happen in a few months. Once PDs are all current by law they have to process by RD. This ofcourse does not always happen but we can hope that it will.

3. July-Aug-Sept are crucial months. I am hoping that everyone with PDs in 2001-2003 get approved before OCT. Anything can happen in OCT. With increased demand they will most likely retrogress dates to atleast 2004 for India EB3. This is my best guess at this point.

4. Processing times will keep ballooing till PDs are current because now people can file PERM, get their 140 and file for 485 within 2 months if they are current. This used to be a staggered process but its not anymore. The limited number of visas is still a problem and another round of severe/rash retrogression is very possible.

Best of luck to all old timers and good luck to the newbies who will get started in July.

I did not inquire about my namecheck but I believe I was stuck in it prior to the retro that began in 2005. I am guessing that my name check got done during the 2.5 years of waiting in retro.
