Stuck again

I think that's because there are no many of us left in the April 2003.

I felt that SF DOL jumped forward and almost hit my April 24, but now everything seems stopped again. I am wondering if this prediction that they will process 24th by the end of the year is going to come true...

Have they completely stopped?? :confused:
 
It's been 5 months, actually it will be five this 23rd since i got the 45 day letter and no response yet. But you guys should be up in the queue eventhough you received it just 3 weeks ago becoz of the Priority Date...
But I guess the 45 day letter doesn't really help to determine when it might get approved. But good luck guys

I have a feeling that they want to go over all the April applications first and then go back to the "3 option letters".. At least I could not find anybody who responded to the 3 option letter and got certified recently. Or maybe it's because they are not on this forum anymore...
 
Those of you guys who responded to NOF (three option letter), there are couple of cases whih got NOF and eventually certified. This is out of my tracking file.

Following cases got certified after three months after they are skipped. I guess these have got NOF, but the system never updated that they issued NOF.

If you guys observe about cases from Oracle Corp, which got NOF officially (they updated the status on AVM), and for certain cases the status also is updated that the rebuttal for NOF has been received (This could be response for NOF), are still in the same status, even after two/three months after receivning response to NOF.

Looks like very few of us unfortunate guys are left over in this forum, and this seems to be the reason for not having posts/status updates in this forum.

Actually I think that NOF and 3-option letter is not the same thing.. In the case of NOF the AVM gets updated, but not in the case of 3 option letters..

Are there any approvals from Apr 24th onwards?
 
Not sure whats happening at SFDOL. The last known case certified was on 6/30, with a DOL RD of 4/24. I haven;t seen any case which was certified in July.

This could be either they are not updating AVM, or they are not working on cases. Hope for the best ...

lets hope ateast we know they will do it by the end of the year given that they are closing the office :), but given that there are so few cases left it doesn't make a difference and moreover since for EB3 the visas are over anyway i am trying to be positive atleast the PD is current for most of us , anyway lets keep each other updated as much as we can , the posts have really gone down from 3-4 months ago either everyone is certified or have got 3 option letters

Whither skipped cases?

Well, I am still optimistically awaiting certification, along with several people I know - all from the same RD of 14th April. Still says 'received'. Skipped cases! Let us hope for the best and remain positive.

BTW, the "3-option letter" being referred to in some posts here is from the BECs, is it not? In those cases, is the SF DOL AVM updated?

Guys! If you are still awaiting certification from the DOL (i.e. RD upto 04/30/03), but are simply reading this forum -- please register and post here! Especially as soon as you get certified. It will certainly be very encouraging to see posts from people as and when they get certified! And it will also help to understand what's going on.

Skipped cases??

Hi Guys,
I have been reading this forum for long time.My case is also struck in infamous April 2003 (April 28- case 95605**).I called 415-975-4601 (option 1,1) and heard the message saying currently they are processing cases between April 28-April 30'2003.What happened to the 24 & 25th cases.....Are they all skipped???

What is that phone number? SF DOL AVM has a different number - 650-975-4617

Phone # for checking individual case status on AVM : 415 975 4617.
(and followed by 1,1 when prompted)

Phone # for checking general status on AVM : 415 975 4601
(and followed by 1,1 when prompted). This# just gives general idea about what is happening.. and what dates they are processing.

It looks like they are processing April 28 cases as of Monday July 18. (Only one case exists for Apr 30), which means that they are on to Apr 28 cases atleast previous week. May be AVM is not updated with the latest certifications.

No, it is not the same thing (that one is known as a 45 day letter).

3 option letter is something that SF DOL sends to RIR applicants.

The options are:
1. Withdraw your application.
2. Remand to state as a regular application (not RIR).
3. Re-test the market.

3 option letter is not the same as NOF (notice of findings).

If a 3 option letter is sent the AVM does not get updated.
