NO... DOL Is very Random In Case Number assignments. Also as SF dol processes cases for Seattle Region, those cases occupy some of the case numbers in between.. On an Average SF DOL has received 1400 SF RIR cases per month. Here is actual number till July & you can assume similar numbers for other months.

Jan 2003 ::1719
Feb 2003 ::1460
Mar 2003 ::1419
Apr 2003 ::1075
May 2003 ::1310
Jun 2003 ::1272
Jul 2003 ::1194
 
What about the number of cases they are processing per month ?
Any one has tracked those numbers ? Are they more than 1400 or less ?

I checked the AVM for last two cases that you have mentioned. It says Recieved.

I don't have a birth certificate and I had sent 2 affidavits (Signed by my parents in Rs 10 Stamp Paper and notarised) to our attorney for review. Below is the response from the Immigration Specialist. Is this valid or not? I just have a few months (4 months) in my H1 and i'm wondering whether it is a must to get it from the local magistrate.

"Because you were both born after the time that registration of birth was required(1970), we will need either a copy of your birth certificates or an affidavit from the local magistrate indicating birth certificates are not available."

I found the folllowing from immigration-law site

If the employer required a bachelor's degree or equivalent plus 5 years of progressive experience as an alternative to a master's degree requirement, the requirement of "a bachelor's degree or equivalent" can be proven only if he/she attained a "single" bachelor's degree either from a U.S. academic institution or a foreign academic institution. Bachelor's degree requires 16 years of education in academic schools. According to an AAO decision, combination of two or more academic degrees cannot satisfy a bachelor's degree or equivalent degree requirement. This decision is based on the specific language in the relevant immigration regulation which requires "a" bachelor's degree or "a" equiivalent foreign degree. Secondly, assuming that he/she is able to establish that he/she attained a 4-year bachelor's degree, the next threshold is to prove the "5-year progressive experience." Again the AAO decision requires that the experience must have been gained "after" attaining a bachelor's degree. Accordingly, any experience which was gained prior to attaining a bachelor's degree cannot satisfy the "5 year progressive experience" requirement.

second last 09549016 is Certified...last one 09549068 is my typo its 09549058 which is certified. sorry for that!

Are the AVM statuses updated only at the end of the day or something?.Also what does the AVM say when they are about to send a 3 option letter to the lawyers??.Can anyone answer these questions?.Thanks

Is the DOB issued by Indian Embassy(San Francisco) valid for I-140 & I-485 filing? Have any body used it?

No its not Valid for Green Card Process. You have to have BC from local govt / City / Gram Panchayat / Birth Registrator.

Not 100% Correct, may be he is trying to be over Safe !... Yes its truth that after 1970 Birth Registration is Must, but was not implemented in India for a long time after that. USCIS understands that & accepts the affidavits instead. You can submit a letter stating that BC is not available & get it stamped by Magistrate.

i also have heard the same thing from my lawyers- if you cannot produce a Birth Certificate you need to have a non-availability certificate along with the affidavits from parents.

GP111, you stated the DOL received dates you as March '04 that have been approved. Dont you mean March '03? The DOL website says that March '03 cases are being processed. Confused!

No, i haven't gotten it as yet.. Mine is not a simple case of a missing or lost birth certificate, it is actually some gap between actual and recorded date of birth.. My parents are pursuing it with the local government offices in India.. I don't know how long it will take to get a non-availability certificate in the simpler case..
