to bring his/her spouse in the USA if they are of the same
sex and the marriage was conducted according to the laws

No. US immigration laws DO NOT recognize same sex marriages.

I concur wih nkm ... us immigration law and also marriage act does not recognize same sex marriage as a marriage for immigration purposes.

I actuallly remmember homosexuality
is on inadmissibility criteria checklist.
It may not be enforcibke now.
