same company - moving from bay area, CA to seattle, WA

Hi All,
I haven't got good fundas on this from anyone... and was hoping to get some insight into this.

My situation:
1. Filed I140 (got RFE - replied, awaiting decision) ND Jan 9th 2003.
2. I485 filed on April 03

While job description, title, salary and company will not change, I have an opportunity to move to seattle.

question is what is the impact on GC. In terms of which center does stuff get transfered too? Should I wait till I140 is approved etc.

Moving to another location will invalidate the labor certification and consequently I140.

AC21 will most likely not apply in your case because:

1. Your I-140 is not approved yet.
2. You are not changing employer (although this can be argued otherwise).

Seek legal advice before making a move.

My move is not likely till maybe 6 months. Hope that I140 will be approved by then.

Will seek legal advice - quality of lawyers my company hires is really poor unfortunately.

Even the boldest opinion out there is that you need to wait atleast 180 days from the filing of the 485 before you can try changing job desc etc. So I would wait atleast till October and the 140 approval (whichever comes later) if you want to go on "the road less traveled"

The conservative opinion would be to wait for 6 months after 140 approval which would be the opinion from most lawyers.

Since there are no regulations regarding job location change, even the conservative opinion carries a significant risk.

BCIS fundas are all screwed up, ain't it?
