Hello, I had certain salary when I filed for my labor and 140. Right now, it is reduced by 15%. Is this an issue, how would the person in the consulate in India would know about my previous salary and current salary. He might know the current salary by looking at pay check, but how would he know about my previous salary.

Please help.

No Title

Your previous salary doesn\'t matter as long as your are paid what they promised in Labor Cert application. Some consulates don\'t even ask for paystubs (like Bombay), but in your employment letter it should be mentioned that how much they are going to pay you/or paying right now (if its for same position) and it should be atleast what was mentioned in labor cert.

Salary need not be mentioned in the employment letter

Best bet is not raise the salary issue at the consulate. Just handover the documents asked for. If at all there\'s a question relating to salary, just handover the pay stub and let them figure it out.

regards

from your GC file

your previous salary is mentioned in your Labor Certificate. and consulate will obviously have that either through NVC (which sends INS file) or AC140. so they would know.....

in essence, your current paystub salary should be equal to or slightly higher than that mentioned in Labor Cert application. If the current salary is too much higher, it might suggest (simply suggest, it is no evidence) a promotion and/or job position change. so avoid that.

my 2 cents

LC application salary is the benchmark.
Salary higher than LC application is acceptable as applicant sometimes has gone through a few promotions and raises.

There might be issues with Salary appreciably lower to the benchmark.. but if it is still higher than the Local Salary for your job then you are still OK.... I doubt that the consulate looks at the salary at the time of CP.. they did not ask my Paystubbs and I doubt they even read the salary statement on the Employment letter

I would say rest assured and you will be OK

Patta Hara,

I agree with you except one thing. You mentioned that is acceptable to go through a few promotions. I think this is deadly, since your position is no longer the one, which was certified on your LC. This makes your LC invalid.

Promotions

I see your point... Your job title mentioned on the Employment letter should be the same as your LC job title. Positive difference in Salary is acceptable.
