Salary Issue and I140

I work for Company A on a H1. The LCA for this H1 states a salary of 40K
and i am earning this salary. Company B already has a pre-approved labor
and has filed for my I140/I485 last week. On this pre approved labor the
salary is mentioned as 70K.
Does this mean that i have to earn $70k annually even when i am working
for Company A? Or does the clock start ticking on the 70K salary start only
when i join Company B?
Pl let me have your inputs
thanks

This should be OK...

GC is for future job. If company B files 140 for you they have to provide a support letter that says they will pay you 70 K once you start working for them either in the process of getting GC or once you get GC. If copany B is ready to do that than you can use the labor. However the abiliy to pay issue has to be sorted out. Company B should be on good standing financally from the day the labor was filed till date.

Another thing to check is the educational eval. If these all are Ok, I believe you have a good chance.

--NO, the comany B is suposed to pay you $70K AFTER your I-485 gets approved

---- if you join B now no need of 70K but after I-485 approval for B then B has to pay that. the salary writen on LC has to be paid after GC approval
