Salary and W2 issue.

Hi Rhino,

My situation is also little similar to yours please update me when you listen from USCIS.
Coming to my situation, I have my 2002 W2 very bad(50% low), this also makes me to go
below the 30K american poverty level... I dont know what to do,,
my current client Hartford Insurance is offering me fulltime and said he is going to
support GC....
as somebody suggested something like if we have bad W2 or low pay, and if we change
job with higher salary, it would be good????

Like you i have been with the same company since last 5yrs.
I spoke to couple of employers but they all are suggesting dont worry,
it wont be a problem, as INS is going to ask only two yrs w2's max, which I will be
having equilent to my labor(2003 and 2004). I have my FP1 scheduled for Nov 22nd, which
makes me to get my w2 for 2004 which is very good.

Also similar to you, I got the same RFE in my 140 (ability to pay), and at that time
my attorney ask me to submit 2001, 02 and 03 W2's which I did and they approved it in
two weeks. Would that make this time I wont be getting same RFE again?

since your I 140 is already apporved , i do think the ability to pay (from employer) has been addressed.

Regarding your Low W2 for 2002 and now changing the job to Hartford Financial ( which is not a bad company) don't worry about the higher salary that is not an issue. If at all it( new salary) is compared it will be compared to your salary on LC . Even then it should not be an issue.

It seems you filed you I 485 last year so you can use AC21.

just to make sure that your title and responsibilities are similar/same..

Title can be similar but it is better to have same job duties on your EVL.

Hi Rhino

Having low W2 is not a issue because I was not working for about 7 months, however the NEW JOB salary should be higher or equal as per my lawyer. Ability of the employer to pay is very important and it has been address big time according to my research and lawyer.

So, that was my experience. Take care

Due to non submission of 1st 2 h1's i.e. not maintaining status which was my attorney's fault.
