S.2045 will make I485 approval taking more time

At least for the people who is in I485 waiting stage now.

Think about it:

1. More H1 means more jobs for INS. If INS does not
double its employee, (only in this way can INS catch up current I485 process speed, which seems not likely in the new future, say in three years?), your I485 has to sit there for longer time no matter what.

(Do you know why I485 is going pretty well now? believe it or not, the only reason is because No H1 process since March this year and more INS officers can
be spared to process I485. It is always the high priority for INS to process H1 than I485, agree? Because basically speaking I485 is for your benifit but H1 is for the US and company\'s benifits).

2. What you will see in the future:
PD is always current, the immigration visa is always available, probably don\'t even reach the per contry limit as INS is busy for whole year on H1 and very little I485 approval. You can change your job, you can extent your H1b after 6 years, you can file I485 without waiting, but, just have to wait longer for I485 approval.

3. So what is the big deal?
The big deal is for those who wants to switch career. Like EB1, EB2 in non-computer areas for quite a long time (low pay, not too much hope for future) who really wants to get GC ASAP and jump into this high-tech area, they will have to either wait longer or start from the beginning.

I agree with you. Increasing the number of H1Bs is going to seriously affect I485 processing. I\'m just glad that there\'s a provision to allow you to switch jobs if you\'ve been waiting for I485 approval for more than 180 days.

I think S.2045 will push things towards brigher
side.

1) Given less restricted quota rules, INS can
process AOS faster if they want to. In 1994,
tens of thousands of Chinese were granted GC
(Chinese Students and Scholars Protection Act?)--
INS processed most of those applications within
a few months.

2) S.2045 requires INS figuring out how to reduce
backlogs of ALL catagories and reporting to the
Congress with 90 days after it becomes the law.

3) Currently, changing jobs under H-1B is such
a painful experience. Sometimes, you have to do
it because your empolyer goes out of business,
you want to switch EB catagories, the job moves
from one state to another, ... Those things have
nothing to do with your job is computer related
or not. You start from beginning if you switch
to another empolyer. Isn\'t that painful? S.2045
helps!
