I filed my RIR application under EB3 in March 2005 (which means that my priority date is march 28, 2005). How does retrogression for EB3 category that starts on July 1st, 2005, affects me?
 
there is no retrogression in EB-3 yet - it is just presently unavailable. That's a big difference. Starting Oct.'05 you will be able to file I-485 again until it once again becomes unavailable or until they actually introduce retrogression.

Make sure that your application is not returned. Because On MArch 28th legally you are eligible to file only in PERM and not in RIR. To file in RIR or non-RIR the last day was 27th March post marked on your LC application.

What do you mean there's no retrogression in EB3? What's the difference? I thought PD moving back to 2002 WAS retrogression.

That implies he is not from a country that's already retrogressed - otherwise it would make no difference. EB-3 worldwide has not moved back to 2002 (yet) - so it is unavailable but not retrogressed. From July-October it doesn't make a difference, but after Oct. 1st it does again. At least you can the immediately file I-485 and if EB-3 worldwide then does indeed become retrogressed you can at least keep working on EAD until you are current and they can approve (or deny) your I-485.

Yes, it was on March 27th, sorry. Last day. But I am still little bit confused about where I can check status of my application. I asked my lawyer is my application sent to New York or in backlog center in Philadelphia, but still do not have respond. Any idea?
 
Please help. I do not have any info where my application is sent? It is RIR filed on March 27, 2005. What would be expected route in my case?

Assumption, you are from India, and PD is March 28, 2005 (PERM or RIR does not matter)

Let us see some historical datas for India

March 95, the date was current , in March 99 it retrogressed to 8 Feb 96
Dec 2004, the date was current, in jan 2005 it retrogressed to 1 Jan 02
June 05, the date was 01 Jun 02, in July 05 it retrogressed (- ) infinity

If it retrogessed certain date, say 1 Jan 02, still you can file your I 485, if your priority date is on or before 30 Dec 2001.

If date is unavailable, it retrogressed to minus infinity.

Suppose you have priority date 1995 (with a substitute labor )and you have I 140 approved, you can not file I 485, until dates are avilble. (See, How much days are retrogressed).

For Your case March 28, 2005, if your LC/I 140 all approved, you may have wait many years before you file your I 485. See historical data for a glance.

Unavailable is worse than retrogression. But, soon "U" become some dates in Oct 2005.
