right to run a business before E2 approval?

Does an applicant of E2 visa have a right to run on own risk a business before getting an approval from USCIS on E2 application?

In past I was always starting to work on H1 after applying to USCIS but before getting an approval.

Is same practice acceptable with E2?

In other words can I do the following?
Apply on Feb 1 to USCIS on E2 and on Feb 3-4 start working in a new business, described in application to USCIS?

Can you please accompany an answer with a source?

You should apply for B1/B2 for business use


You cannot do manual work as such, nor draw a salary

What you can do is mangerial, set up types of things like

meet with attorney to set company name up

Meet with suppliers, interview staff, do paperwork for lease on shop etc.,

I am assuming you are trying to change your status in the U.S. by applying through USCIS rather than consular processing. The E-2 is different than the H-1, which allows you to continue working for the same employer when requesting an extension. You must wait for E-2 approval before you are allowed to "work" at your newly set-up company. The term "work" though is vague. Basically, until you get approval, you cannot derive a salary. To be on the safe side, it is better not to engage in any activities that may be construed as work.
 
Now , I have B1/B2 Multi 10 years visa, If I will fill the E-2 VISA or L1 VISA, Do I still have B1/B2 10 Years VISA valid. I am the owner of company in Thailand and would establish the company in US and I will relocate to USA, I heard that L1 would be lead to permanent residence visa. What do you think which option I would apply for?
