I received the PHOTO COPIES of THE COPIES of original RFE\'s on 11/6. It was definitely the result of my talking to a nice lady last week who promised to pull out our files and have the RFE\'s sent directly to my home address. They were sent the day after I talked to her. The original RFE\'s were said to be sent on 10/9 and the address shown on the form was the attorney\'s. There was indeed a stamped "OCT 9 2001" shown on the copy. No original copy is seen yet. That tells me one thing: although it may not work sometimes or most of the times, it worked for me this time when I though that I had to take it into my own hands and that I could not count on ANYBODY ELSE!!!!

What they want, in addition to my employment letters, W-2\'s and pay stubs, they also want some items/proofs that were not included in the filing, but which I did forward to the law firm. For instance, they want copy of my old passport which I used to enter US and which was not submitted by the law firm. As I KNEW, one only needs to submit the copy of current passport since I checked with the law firm after I received the package right after filing. They want to know my whereabouts for the 5 years when I was in school because nothing tells them that in the filling documents, because the I-20 forms were not submitted either (I found out last night). Are these absolutely necessary documents? Do these things sound disturbing to you guys?

What puzzles me too is that they want to verify my wife\'s current employment status and want employment letter on original letter head in addition to pay stubs, etc. My wife is beneficiary in this case. They also want proof of my wife\'s legal working status for certain period of time, because her H-1B for that period was NOT included in the filing. That disturbs me even more.

I have a few questions for you guys: 1) Why do they even bother to check beneficiary\'s employment status now? I know some other people had similar situation. 2) Is INS just getting so paranoid that they are wanting things they did not normally want before? 3) Have a lot of mistakes been made in my filing?

Anyway, I felt relieved after receiving the RFE\'s. I have no trouble giving everything they want. I feel lucky that I am still employed.

I simply want to share these information with you guys so that people can avoid unnecessary troubles. This holds true to both us applicants and INS officers. I am sure INS officers do not enjoy seeing incomplete filings. And obviously, I will be happy if us applicants can avoid some frustrations.

Something made me curious about one thing. Do your attorney want more money for responding to RFE? Do they want more money for submitting amended I-140 etc.? And, how much do they want? Response will be appreciated. Thanks!

Henry your lawyer is dum. If the things are filed properly then you would not have got RFE like this.

Well even if all the information is filed still you get RFE for W2\'s and stuff like that.

According to your information that you have not attached I-20 how will one know on what status U are at that time. You have to provide your five years of stay and what U are doing at that time.

These things are missing along with other papers so your lawyer is not good at filling I-485.

I think on this site or Ciba\'s site you can get a list of papers that have to be filed with your I-485. Now if your lawyer says something make sure (cross check) he/she is doing the right thing.

Thanks for your kindness. As a matter of fact, we provided all the documents that the RFE is asking for to the law firm at the time of the filing including my I-20, my old passport and all my wife\'s H-1B copies, 3 years W-2\'s, etc. We actually found out that some things were missing after the filing. We either were convinced by the firm that we did not need them submitted or thought it was too late and better count on our luck. That\'s why I said this whole thing disturbs me, and that\'s all I want to say now.

It maybe true that I may still get RFE for W-2\', etc. However, if all the other things had not shown up on the INS officer\'s screen, who knows, they might not even want to issue the RFE\'s. Apparently, there were just too many problems in my filing and even I would want to issue a RFE.

What\'s even worse is, I am afraid that our medical exams will be over 1 year old by the time when our files get back on an officer\'s desk, which probably means that another RFE for new medical exams will come, it\'s horrible to even get into that.

Looking back, at that time one decision was made by the recommendation of my employer and I did not have other choice of.....
